GALLIPOLIS, Ohio (WSAZ) -- Deputies in Gallia County are investigating a home invasion where one of the suspects was shot.

The sheriff’s office says it happened shortly after midnight on Clay Lick Road. They say that after the suspects broke into the home, they brandished a weapon at the homeowner. Investigators say the homeowner was able to get a shotgun and shoot one of the suspects in the shoulder. Both suspects were able to flee the scene.

Investigators say a short time later; the sheriff’s office got a call form Holzer Medical Center that a man had been dropped off at the emergency room with a gunshot wound to the chest. That man is believed to be one of the home invasion suspects. He was later transferred to St. Mary’s Medical Center in Huntington. He is said to be in critical, but stable condition.

Investigators believe the driver of the car was the other suspect in the home invasion.

The sheriff is not releasing any names at this time due to the ongoing investigation.

I commend this man for protecting himslef and his family. Thank God for the newly passed Castle Docterine Law. As of Sept 9th a person's residence or car is designated as a place where they are protected from illegal trespassing and violent attack. Therefore a person NOW HAS LEGAL RIGHT to use deadly force to defend that place from violent attack or an intrusion that may lead to violent attack. Finally a law to protect the victims.

Better check ur facts since ohio passed house bill 184 the intruders can not sue and u are presumed to be acting in self defense now instead of having to prove it as before. It is a good law and soon these crooks will get the hint that people are fed up with their madness may take a few more killings but they will catch on

i"m glad this home owner defended himself, and his home. i wouldn"t want any one coming in my home unenvited either. if they do, they will pay.

It's great he protected his home, etc. It's too bad we have such a screwed up legal system that he's opened himself up for a law suit. The criminal can sue him for medical, trauma and other compensation. You do have a legal right to protect yourself and your property, but recognize that you may end up in court if you shoot an intruder or whack him over the head with an iron pipe. You would have to argue that you really did act in self-defense or in defense of your property, and it would be up to the jury to decide whether to believe you. Basically, the law says that you can use reasonable force to defend yourself if you're being attacked or if you have a reasonable belief that you will be attacked. That is, you don't have to wait until the intruder is actually coming at you with a knife. The key word here is "reasonable"; the jury would have to decide whether a reasonable person would have thought that a toy gun was real or that a hand going into the pocket was reaching for a weapon.

Maybe if we start shooting people when they break into our homes and we are in fear, the prisons would be less full and criminals could stop getting so much time of their sentence suspended.

I am a republican, but I praise Ted Strickland for his insight on home defense. In west virginia, an 88 year old woman was robbed in her home, but that didnt happen in gallipolis this time. GOOD JOB!!!

Nothing like a shot gun to get a fellow's attention.

Give this man a medal and the key to the city. He should run for council/mayor, I would vote for him.

Good Job home owner!!!! I say everyone needs a gun in every room for protection.

This is the second home invasion in a week. A family had a home invasion last monday also. The results of that was the homeowner and his grandson were injured. The homeowner had to go to the hospital and they got away with stuff. They duct taped the man up and hit him in the head with his own gun. It just seems to be getting worse. The men who done it last monday were looking for drugs at the residence. Im just wondering who it was that done this one and who the family was this happened to. The criminals are getting braver anymore.

This is the way every criminal should be treated when they break into someone's home, maybe this will help slow it down. Thank GOD the victim is ok

Posted by: dave on Dec 3, 2008 at 10:05 PM
Too bad he did'nt get both of them. people are tired of all the break ins.Make sure you put there names out so people will know who to watch out for.

Posted by: Rod on Dec 3, 2008 at 08:13 PM
This needs to happen more often. Break in my house, threaten family etc... expect to be shot. You lose your all rights, including the right to breathe, when you decide to commit these crimes.

Good News in the News! A homeowner successfully defending his castle from people that feel they deserve to take things from others. We need to hear more stories like this with happy endings.

I must say this thief asked for what he got. Too bad the other one got away. This day and times like these call for actions of this type. Shoot 'em that gets them off the streets. I certainly won't make a comment supporting any low life thief.

Posted by: alan on Dec 3, 2008 at 05:41 PM
To bad he didnt get a shot at both of them. Worthless thieves.

Posted by: Dwayne on Dec 3, 2008 at 05:37 PM
Good for you, for having the resolve to stand up for yourself and your family. I hope that this sends a message to other would be criminals that some of us will not bow down to violent crimes and we will protect ourselves. Again, GOOD JOB!!!

Posted by: Cylb on Dec 3, 2008 at 04:24 PM
Weapons were shown to the homeowner and he had every reason to believe he might get killed. I'm glad the homeowner got the shot in and I don't care what condition the thief is in....he had no business in that person's home and he got just what he deserved!

Posted by: Beth on Dec 3, 2008 at 04:08 PM
How can it go from shoulder to being shot in the chest? There is a big differnce there?

Posted by: anon on Dec 3, 2008 at 03:55 PM
way to go homeowner. this is what needs to be done all across America. We need to stand up and take care of ourselves, because aint nobody else gonna do it for us. Give that man a metal.

Posted by: Mike on Dec 3, 2008 at 03:29 PM
Good, Maybe that is the message we need to send to these LOW LIFE THIEFS. They got what they deserved. Finally some real justice. God Bless the family who these thugs attempted to harm.

Posted by: Kim on Dec 3, 2008 at 02:45 PM
Way to go homeowner for defending yourself, your family and your home! Don't be suprised if there are comments made on here that YOU should be charged for shooting a person that was brandishing a gun at you first. Seems like people ALWAYS defend the criminal! But don't feel bad, I would have done the SAME thing if I was in your shoes!

Posted by: Mom on Dec 3, 2008 at 01:18 PM
He had every right to shoot. These thugs better think twice, before doing this stupid crap.

Posted by: Kathy on Dec 3, 2008 at 12:28 PM
well, that's what happens when you break into peoples homes idiots! same would happen at our house if you try that as far as i know, we still have the right here in this country to defend ourselves, our family, others and our property and thank God we do with all these criminals being so bold and brazen they break in even when they know people are home I have NO sympathy for them

Posted by: Mark on Dec 3, 2008 at 12:15 PM
Good! I hope the criminal lives to remember getting shot for his crime. I have no pitty for people that do home invasions. They are just asking to get shot and will be shot if they go in my house!

Posted by: Anonymous on Dec 3, 2008 at 11:13 AM
This is why every homeowner must take up arms.

Posted by: Anonymous on Dec 3, 2008 at 10:56 AM
Gallia County is getting tired of people breaking in and taking what we have worked hard for. DO NOT MESS WITH GALLIA COUNTY>>>>

Posted by: Joe on Dec 3, 2008 at 10:50 AM
Thats exactly the way it should happen. You brake into someone's house you get your arse shot !!!! Obama voted you could not shoot someone in your house. We have to stop having sympathy for the walking dead drug zombies...

Posted by: Jeff on Dec 3, 2008 at 10:28 AM
Excellent, homeowners are fighting back! This must continue and eventually people will figure that the risk of robbing someone isn't worth the goods that they will hock to buy dope!

Posted by: good on Dec 3, 2008 at 10:12 AM
thats what the punk gets too bad the home owner didnt get the other one too.

Posted by: Anonymous on Dec 3, 2008 at 10:07 AM
Thank God the homeowner is okay! I'm very pleased to hear that the homeowner took action so quickly and shot at least one of the criminals.
