Sago Survivor Sues Coal Company

It's been more than seven months since 12 miners died inside the Sago Mine in Upshur County.

There have been several investigations into the tragedy and the family members told us all along they were not satisfied with the answers they received. The investigations are now over. Now, some of the families are seeking answers in court.

Wednesday, Randy McCloy, the sole survivor, and the families of deceased miners Jim Bennett and Martin Bennett filed separate lawsuits against six companies including International Coal Group. The suits claim the companies, supply companies, even repair companies all played a part in the deaths of those 12 miners back in January.

As part of McCloy's lawsuit, Randy's wife Anna says she lost part of her husband that can't be replaced. Both the McCloy family and the Bennett family want damages and a jury trial.

Despite the independent investigations into the tragedy, there was never a specific finding of what sparked the explosion.
