Prosecutor to File Lawsuits to Recover Delinquent Taxes

CHARLESTON, W.Va. (WSAZ) -- The Kanawha County Prosecutor will file lawsuits Tuesday against three corporations who have delinquent property taxes that total more than a million dollars.
According to a news release, Summit Equipment and Leasing, Inc. owes $41,594,29. The county also reports Helicopter Flight Services, Inc. owes $9,010.31 and Mountain International Trucks, Inc. has $50,254.67 is delinquent property taxes.
"It is my statutory duty to ensure the system is fair to all taxpayers because every penny that one taxpayer doesn't pay adversely affects the other law abiding citizens in this County," Kanawha County Sheriff Mike Rutherford said.
The Sheriff's Tax Office provided delinquent property tax information to the Prosecuting Attorney's Office. Now a prosecutor has been assigned to handle these collections.
According to a news release, what the county calls "demand letters" were sent to 20 companies with delinquent property taxes. The companies have thirty days to respond.
So far, the sum of $53,093.58 has been collected from Caterpillar Financial. A county spokesperson tells WSAZ.com Caterpillar Financial still owes the county money, but a lawsuit will not be filed against the company yet.
We're also told seven other companies have asked for more time to respond.
"There will be more demand letters sent, and I will not stop until I have exhausted all legal remedies to collect the delinquent taxes owed to Kanawha County," Prosecuting Attorney Mark Plants said. "My office is committed to serving and protecting all the taxpayers of Kanawha County."

The county also plans to go after residents who have delinquent property taxes.
