CHARLESTON, W.Va. (AP) - The West Virginia Supreme Court has ruled in favor of a same-sex couple fighting to retain custody of an 18-month-old foster child.
In an unsigned opinion issued Friday, the court barred enforcement of a Fayette County Circuit Court order that the girl should be taken away from Kathryn Kutil and Cheryl Hess. Judge Paul Blake Jr. had ruled the child should be placed with a heterosexual couple who might adopt her.
he court says that was an error. The justices say Blake blurred legal principles applicable to abuse, neglect and adoption. Current law, the court says, encourages adoption by qualified foster parents and either Kutil or Hess should be considered - and perhaps favored - as a prospective parent.
The women's attorney, Anthony Ciliberti Jr., says he and his clients are pleased and hope to move forward with adoption proceedings.

I am so glad that court ruled to keep this child with the people who have ared for and nurtured her. As long as they love her why does it matter if they are gay or straight.
Roane Co. YOur an Idiot....
Touched a nerve apparently. Oh well it happens. Just remember that more good men have died for god and country than any other cause. Pity. And by the way this country was created because people did not want to pay taxes to the king of England, not for religious freedom. That was just an afterthought. Besides I believe as does Larry Flynt that the most precious freedom is the freedom to be left alone.
