The obstruction charge against Clendenin Mayor Bob Ore has been dismissed. A Kanawha County magistrate dismissed the charge this week.
Ore had been accused of interfering in police business by telling Clendenin police officer C.L. Burkhamer over the phone in April not to arrest a couple on domestic battery charges.
After swearing out an arrest warrant for Ore in June, Burkhamer was fired for gross insubordination. Burkhamer subsequently filed a wrongful termination lawsuit, which is still pending.
Magistrate Marva Crouch dismissed the obstruction charge against Ore on Wednesday, agreeing with the defense that the mayor controls the police department and therefore has the authority to give instructions to officers.
Ore says he's pleased with the dismissal and that the charge never should have been filed in the first place. Burkhamer wants an independent investigation into the handling of the case.
