A Kanawha County judge postponed Clarence "Trey" Ilderton's trial until January.
The court is waiting for Ilderton's mental competency report.
His attorney, John Mitchell, Junior, said the psychologist's report stated lderton is competent to stand trial.
Clarence is charged with strangling his wife Robin in their South Hills apartment in October of 2005.
The couple's two year old son was home at the time of the murder.
