UPDATE: Judge Upholds Life Sentence for Charleston Teen
A teenager who shot a pregnant woman in the stomach killing her unborn child will stay behind bars for the rest of his life.

CHARLESTON, W.Va. (WSAZ) -- A teenager who shot a pregnant woman in the stomach killing her unborn child will stay behind bars for the rest of his life.

Kelly Chapman, was arrested back in November 2008 after he shot Nastasha Folden in the stomach.

She was five months pregnant at the time. Folden survived, but her unborn baby did not.

Chapman who was just 16 years-old at the time of the crime was charged with murder and sentenced to life without mercy in July 2009.

Judge Duke Bloom said he would re-visit the sentence when he turned 18.

Well that happened Friday and Judge Bloom ruled that Chapman's sentence will stand.

Chapman will be transferred from a youth detention center to the Mount Olive Correctional Complex.

CHARLESTON, W.Va. (WSAZ) -- A teenager convicted of murdering an unborn baby could spend the rest of his life behind bars.

A judge sentenced Kelly Chapman, 16 of Charleston, Wednesday to life in prison without mercy. Typically, "without mercy" means no chance of parole. However, by law, since Chapman is a juvenile the judge has to reconsider his sentencing when he turns 18.

Back in May, Chapman pleaded guilty to murder and attempted murder.

He was just 15-years-old when he shot Nastasha Folden in the stomach back last year. Folden was five months pregnant and lost her baby.

Police say Folden was arguing with Chapman when he threatened to get a gun and shoot her.

Kanawha County Prosecutor Mark Plants believes this is the first time the West Virginia's Unborn Crime Victim's Act has been used. The law treats a pregnant woman and her unborn baby as separate victims.

The judge also sentenced Chapman to 15 years consecutively on the attempted murder charge.

I personally know a girl whom this Nastasha Folden was harrassing so if she doesn't have the time she sure found it when she made it her mission to try to do the exact same thing to the other girls child that Kelly did to her son. She knows what she did and so do the police but everyone from Aaron James in the Charleston Police department tried to cover her behind and members of her family's as well when the girl reported the crimes happening against her, the threats made against her unborn child and all the voicemails sent to the girls phone with numbers for the police to see. So do not sit and act as if this girl and her family members are innocent victims, look deeper into this and others because trust and believe they've done something to make others react.

He doesn't have the right to decide if she carried the baby or not just like she doesn't hold that right to make the decision for someone else. This girl and her family did everything in their power to try to end the life of another girl's unborn child before Ms Folden lost her son. So please don't try to make a victim out of a villan!

Anonymous. I know nastasha real well and I don't believe she cares or even has the time to harass anybody. To me it sounds like u have no life and to much time on ur hands, do u wake up thinking about her. How much do u know her. Ask urself why do u even care to say her name if she's such a horrible person. Life is to short I would take her situation and learn that anything can happen. Sounds like u may envy her. RIP to the innocent Life that was loss in such a crazy situation. Nastasha is strong an will make it to the top if u meet her for even a second you'll know my words are the truth. Continue to think what u like she's alive ,she has a purpose. My friend to the end God loves us.......
