Local Law Firm Gathering Information from Clinic Patients
A local law firm says it is hoping to get some answers for people after a recent injection warning at an outpatient clinic in Charleston.

TEAYS VALLEY, W.Va. (WSAZ) -- A local law firm says it is hoping to get some answers for people after a recent injection scare at an outpatient clinic in Charleston.

The Prim Law Firm had an advertisement in the Tuesday edition of the Charleston Gazette asking clients of Dr. J.K. Lilly at Appalachian Pain Clinic to please contact them if they were treated at the clinic between April 27th and May 13th, 2009.

The Kanawha-Charleston Health Department has not released the name of the clinic where "significant infection control breaches occurred," but according to a news release from the department, the dates of patients possibly affected are the same as those listed in the law firm advertisement.

The Health Department says that patients stand a small theoretical risk of blood-borne pathogens including HIV, Hepatitis C and B.

Dr. J.K. Lilly tells WSAZ.com he appreciated the opportunity to tell his side of the story but didn't want to "try (the case) in the media."

Lilly says the investigation continues and his office is cooperating.

Meantime, attorney Brian Prim tells WSAZ.com that he's heard from grandmothers fearful of holding their grandchildren and teachers afraid to return to school.

Dr. Rahul Gupta is the director of the Kanawha-Charleston Health Department. He tells WSAZ.com, "We did not find any evidence of definitive transmission in these patients. In that situation the overall risk of disease transmission of one of these diseases Hepatitis B and Hepatitis C and HIV at a population level is very low, so the individuals need to understand that their risk is low. It's a dangerous situation but their risk is not that high, but again it's not zero."

All patients affected by the initial staph infection that tipped the health department off to this situation have been treated and released from the hospital.

My friend that is sick due to all this does want to learn all she can and it took alot of people to talk her into getting a layer.She is a good person and never wants to hurt anyone even if she is hurt. this Dr knew what he was doing and her husband had to missed alot of work plus she has over 60 thousand in med. bills so yes she needs all the info she can get but why should she be stuck with all the bills this Dr caused her to have. What I am saying is if you dont know all the parts to a story why say anything at all.we are all praying for her recovery and all she prays for is to able to 4give this Dr.

Debbie, I agree with what you're saying. My situation was years ago, and it was a dentist performing oral surgery. After he fired an employee, she disclosed to patients that the dentist was not sterilizing instruments and had, on occasion, reused needles. You're right: the worry and panic and "what if's" is enough to drive one insane. Not to mention the periodic testing for months/years afterward. But I found no shortage of medical (not legal) personnel willing to educate me on the potential risks. The lawyer in this story said he was going to try to find some answers: do you imagine he'll do that for free? Hardly. My point is, less than 72 hours after the story broke, potential litigants were already lining up. While I realize someone's on the hook for the cost of testing, etc., can't we at least PRETEND not to be motivated by the lure of a fat settlement check?

For the record, I deeply sympathize with each one of the patients. What I am trying to say is, having a potential exposure myself several years ago, my first and ONLY priority was to get myself to a medical (not legal) expert who could tell me exactly what to expect. I was moving like my hair was on fire, and it never occured to me to stop off at a lawyer's office on the way.
