UPDATE 5/1311 @ 1:40p.m.
BOYD COUNTY, Ky. (WSAZ) -- A former special education teacher and coach at Boyd County Middle School has been seen sentenced for "sexting" with a 14-year-old student.

In April, Creth Boyd, 29, of Ashland pleaded guilty to unlawful transaction with a minor, a second-degree felony.

Boyd was originally charged with a felony count of unlawful use of electronic means to induce a minor to engage in sexual activities.

On Friday, at the request of the victim’s parent, Boyd was given a probated sentence during a hearing Boyd County Circuit Court.

The Commonwealth Attorney says Boyd’s teaching certificate has been terminated. He was also ordered to have no contact with the victim. His probation will continue for 5-years and if he violates the terms of the probation he can be sentenced to prison.

Commonwealth Attorney, David Justice says Boyd sent more than 500 messages, many of which were pornographic, to the student during a time period of about a year.

Justice says on one occasion, Boyd was seen outside her house at night, “sexting while engaged in an activity unprintable” in this press release.

UPDATE 4/18/11 @ 1:45 p.m.
BOYD COUNTY, Ky. (WSAZ) -- A former special education teacher and coach at Boyd County Middle School has made a plea deal in a "sexting" case.

During a hearing Friday, Creth Boyd pleaded guilty to unlawful transaction with a minor, a second-degree felony. Boyd was originally charged with a felony count of unlawful use of electronic means to induce a minor to engage in sexual activities.

The charge stems back to Boyd getting involved with "sexting" a 14-year-old student.

Boyd faces five years in prison when he is sentenced next month.

ORIGINAL STORY 11/25/09
SUMMIT, Ky. (WSAZ) -- Law enforcement officers and prosecutors say "sexting" -- sexually-oriented text messages -- are becoming increasingly common between teachers and students.

At Boyd County Middle School, former special education teacher and athletic coach Creth Boyd, 29, became involved with a 14-year-old student, police say. It was an involvement that developed into what police say was an illegal e-mail relationship and so called "sexting." Court documents show Boyd faces the felony charge of unlawful use of electronic means to induce a minor to engage in sexual activities.

The mother of the alleged victim told WSAZ.com that her daughter helped Boyd in his special education class and that they developed a relationship that went on for more than a year. The mother said the e-mails became very sexual and extremely explicit, and she referred to Boyd as a stalker.

David Justice, the prosecutor in the case, says the "sexting" charge involving a teacher and student seems to be a recurring criminal theme.

In a separate case in Carter County, Ky., detectives say Olive Hill senior citizen David Gilliam faces an electronic crime charge involving possession of Internet material showing sexual performance by a minor and using a minor in a recorded sexual performance.

Investigators say Gilliam made sexual digital video recordings and -- in this ongoing probe -- they say there are additional child victims in Carter County and surrounding areas.

Gilliam is being held in the Carter County Detention Center, and we're told federal charges may follow.

Boyd, meanwhile, is free on bond. His arraignment on the electronic sex crime charge is set for Dec. 4.
