CHARLESTON, W.Va. (AP) - A Wyoming County man who says he found a condom in his iced tea glass last Mother's Day is suing the Shoney's restaurant in Logan and the company that operates it.
James Bledsoe's lawsuit was filed Thursday in circuit court in Kanawha County, the county where restaurant operator ShoRest L-L-C is located.
The restaurant manager, assistant manager and server are also named as defendants. The lawsuit alleges that Bledsoe and his family were eating at the Logan restaurant last May 14th when he saw the condom in his half-finished drink.
While Bledsoe's initial blood tests for communicable diseases came back negative, he expects to require several tests a year for the next seven years.
The lawsuit, which requests a jury trial, seeks an unspecified amount in both punitive and compensatory damages. It accuses the defendants of negligence in violating food standards and alleges that Shoney's failed to property train and supervise its staff. It also alleges that the evidence -- the condom -- was intentionally destroyed.
A call to ShoRest Chief Operating Officer Rorey Smith was not immediately returned.
