HUNTINGTON, W.Va. (AP) -- Two Boyd County, men who say they were sexually assaulted by comedian Andy Dick at a West Virginia nightclub in 2010 have filed a civil lawsuit seeking unspecified damages.
The 26-year-old from Ashland and 35-year-old from Catlettsburg are also involved in a criminal case. Dick's trial on two counts of felony first-degree sexual abuse is set for May 1 in Cabell County Circuit Court.
Dick has pleaded not guilty to charges he grabbed a bouncer's crotch, and groped and kissed a patron while in town for shows at a comedy club in Huntington. The acts allegedly occurred at another establishment.

Dick's attorney, Marc Williams, says the lawsuit is just an attempt to get money from a celebrity.

HUNTINGTON, W.Va. (WSAZ) -- Comedian Andy Dick's sexual assault trial is now set for May 1 in Cabell County.
Dick was indicted on the charges in June and a month later, he pleaded not guilty to the charges against him.
His trial was originally set for January 17. It was rescheduled for May during a hearing Friday in Cabell County Circuit Court
Dick was arrested on January 23, 2010, following an incident at Rum Runners, a night club, along 3rd Avenue in Huntington.
According to the indictment, he allegedly grabbed the crotch of two men in the club that night. Dick also allegedly kissed one of the alleged victims, and licked the neck of another.

HUNTINGTON, W.Va. (WSAZ) -- Comedian Andy Dick has pleaded not guilty to two counts of sexual assault.
Dick was arraigned Friday morning in Cabell County Circuit Court after being indicted by a grand jury last month.
The comedian had nothing to say as he entered the courthouse. While walking in, Dick was greeted and served papers for a lawsuit being filed in the state of Texas.
Following the not guilty pleas, Judge Paul Farrell set his trial for January 17. A pre-trial hearing is set for Sept. 29.
Dick was arrested on Jan. 23, 2010, following an incident at Rum Runners, a night club, along 3rd Avenue in Huntington.
According to the indictment, he allegedly grabbed the crotch of two men in the club that night. Dick also allegedly kissed one of the victims, and licked the neck of one of the alleged victims.

HUNTINGTON, W.Va. (WSAZ) -- Comedian Andy Dick has been indicted by a Cabell County Grand Jury.
Dick is facing two counts of first degree sexual abuse.
Dick was arrested on January 23, 2010 following an incident at Rum Runners, a night club, on 3rd Avenue in Huntington. According to the indictment, he allegedly grabbed the crotch of two men in the club that night. Dick also allegedly kissed one of the victims, and licked the neck of one of the alleged victims.
The indictments were unsealed at 4 p.m. on Wednesday.
Dick's case will be handled in Judge Paul Farrell's court.

HUNTINGTON, W.Va. (WSAZ) -- Comedian Andy Dick returned Tuesday to Huntington for a preliminary hearing on two sexual abuse charges.
Dick is accused of first-degree sexual abuse in two separate cases at a Huntington bar last January.
Assistant Cabell County Prosecutor Sean Hammers and Dick's attorney Mark Geragos questioned the first accuser who remains unidentified. He was working at he bar where the alleged incidents occurred.
"He (Dick) walked through the door, walked by me tried to walk into the club," the accuser testified. "I grabbed him and said, 'I need to see your ID.' He didn't have his license. He said it was stolen on the airplane."
Dick was performing at the Funnybone comedy club that weekend.
The accuser said after he put a wrist band on Andy Dick, the accused put his hand on his genitals.
"Turned around, there he is tilting his head smiling at me," the accuser testified. "I jumped back, shocked he actually did it."
During the cross examination, Geragos asked, "Did you kick Mr. Dick out of the club?"
"No," the accuser responded.
Geragos continued, "Did you ask him to leave? Did you do anything at all to make a report in the first 30 minutes after this happened?"
"I was in shock," said. "I couldn't believe he did it."
Hammers questioned the second alleged victim who accused Dick of kissing his neck and touching his genitals. He said he was trying to get a picture of Dick with his girlfriend in the noisy nightclub.
"As he was hollering, talking, he kissed my neck," the second accuser said. "As I turned around, it was shocking. I was trying to walk away, I felt a hand go in my pants."
On cross examination, Geragos identified discrepancies on one report regarding the date of the alleged incidents and whether the alleged victim could verify what was written on the report.
After all testimony, Magistrate John McCallister found probable cause to send the case to the grand jury. If both sides are ready, that hearing could be in August when the next grand jury convenes.

HUNTINGTON, W.Va. (WSAZ) -- Comedian Andy Dick returned to Huntington Tuesday for a preliminary hearing on sexual abuse charges.
Dick was arrested on January 23 following an incident at nightclub on 3rd Avenue in Huntington.
According to the criminal complaint, a security guard and a patron claim that the comedian abused them by grabbing their genital areas.
Police charged Dick with two counts of 1st degree sexual abuse.
Tuesday’s hearing took place in Cabell County Magistrate Court. Dick is being represented by well known celebrity attorney Mark Geragos. The hearing was originally scheduled for March.
Following testimony from the accusers, Magistrate Johnny McCallister bound the case over to a grand jury.
Dick was in town performing at the Funny Bone Comedy club when the incident took place.

HUNTINGTON, W.Va. (WSAZ) – It will now be March before Andy Dick is scheduled to return to Huntington to answer sex abuse charges.
And when he returns, Dick could be represented by high-profile Hollywood attorney, Mark Geragos, according to officials in the Cabell County Prosecutor's Office.
Dick was arrested in January at a club in downtown Huntington.
According to the criminal complaint, a security guard and a patron claim that the comedian abused them by grabbing their genital areas.
Police charged Dick with two counts of 1st degree sexual abuse. His preliminary hearing was scheduled for February 2, but has been postponed until March 29.
An assistant Prosecutor tells WSAZ.com that a local law firm is helping to get Geragos approved to practice law in West Virginia so he can assist in representing Dick at the hearing.
According to several Web sites, Geragos' past clients include Michael Jackson, Winona Ryder, Scott Peterson Jeremy Mayfield and Chris Brown.
UPDATE 3:30 pm
HUNTINGTON, W.Va. (WSAZ) – If actor and comedian Andy Dick is found guilty of felony sexual abuse, he could face one to five years behind bars and up to $10,000 in fines.
Early Saturday morning, Dick was arrested and charged with two counts of sexual abuse in the first degree.
The incident happened at Rum Runners on 3rd Avenue in Huntington.
According to the criminal complaint, a security guard at the club claims he was trying to put an armband on Dick when he became the victim of sexual abuse. The guard says Dick grabbed his crotch and began laughing.
Another man says that Dick sexually abused him. The man says he was talking to Dick when, "unexpectedly and without invitation," Dick "grabbed his crotch and began kissing him." This was witnessed by the victim’s girlfriend.
Dick was taken to the Western Regional Jail. His bond was set at $60,000. He has posted bond and was let go at 3 p.m. Saturday.
Dick has stated he will hire an attorney to represent him.
He is scheduled to appear in court in Cabell County on Tuesday, Feb. 2, 2010 at 10:30 a.m. for a hearing.
UPDATE @ 12:55 p.m. Saturday
HUNTINGTON, W.Va. (WSAZ) -- Actor and entertainer Andy Dick has been charged with two counts of sexual abuse for allegedly groping two people at a Huntington bar.
A news release from Huntington Police says Dick groped a bar employee and bar patron while at Rum Runners bar on 3rd Avenue early Saturday morning. The incident happened around 2:30 a.m.
Police say the two victims claim Dick groped their genital areas against their will.
Dick is in Huntington to perform at the Funny Bone Comedy Club and Restaurant. The owner of the club says Dick will perform his regularly scheduled shows.
Dick's bond was set at $60,000. He posted bond at about 3 p.m. Saturday.

HUNTINGTON, W.Va. (WSAZ) -- Huntington Police arrested actor and entertainer Andy Dick around 4 a.m. Saturday, and charged with two counts of sexual abuse after things at a Huntington bar allegedly went too far.
Dick is in town to perform at the Funny Bone Comedy Club and Restaurant. No word on how his arrest will affect his shows at the club this weekend.
WSAZ.com was the only media outlet to get video of Dick after his arrest (click link above to watch). When asked why he was going to jail, Dick said it was for "people grabbing on me."
Dick will stay at the Western Regional Jail until he is arraigned later Saturday morning at magistrate court.
