Massey Energy CEO Files Defamation Lawsuit

Massey Energy President and CEO Don Blankenship has filed a defamation lawsuit against the West Virginia Democratic Party.

Blankenship claims the party falsely portrayed him in a television ad as saying the deaths of 14 miners at the Sago and Aracoma mines were statistically insignificant.

According to the lawsuit, the party's "Not For Sale" ad mispresented statements attributed to Blankenship in a February 19th, 2006, article in The Herald-Mail of Hagerstown, Maryland.

State Democratic Party Chairman Nick Casey also is named as a defendant. The lawsuit was filed Friday in Kanawha County Circuit Court.

Casey said he couldn't comment because he hadn't seen the lawsuit. The lawsuit seeks unspecified compensatory and punitive damages, along with a public apology from the defendants.
