Telecommunications Company Seeking Dismissal of Lawsuit

FiberNet is seeking the dismissal of a lawsuit filed over a service outage, saying the plaintiffs didn't make any claims that could be compensated.

Three FiberNet customers filed the lawsuit July 12th in Wood
County Circuit Court, two days after an outage knocked out all or
some service to 11,000 customers.

The lawsuit, which seeks class-action status, was moved to U.S. District Court last week.

The plaintiffs are Complete System Support of Parkersburg, Neurological Case Management Associates LLC of Charleston and South Charleston private investigator H.E. Gene Sigman.

They allege breach of contract, fraud and negligence.

FiberNet denies the allegations.

The company blames an equipment failure at its downtown Charleston office for the outage.
