SUTTON, W.Va. (AP) - A Patriot Coal subsidiary has been cited by state regulators for a roof fall that killed a miner in Boone County.

A report by the West Virginia Office of Miners' Health, Safety and Training says an unsafe procedure was used to install wall-control bolts at Newton Energy's Peerless Rachel Mine near Racine.

The report says it was common for workers installing bolts at the mine to walk under unsupported roof.

63-year-old Asa Fitzpatrick of Kermit was killed on March 13 when rock fell on him as he prepared to install wall-control bolts.

The state agency released the report Tuesday during a meeting of the West Board of Coal Mine Health and Safety in Sutton.

Patriot Coal officials declined to comment on the report.

BOONE COUNTY, W.Va. (WSAZ) -- A bolt operator with 40 years of mining experience died in a mine accident on Wednesday.

Public Information Specialist Leslie Fitzwater says Asa Fitzpatrick, 63, of Kermit, died Wednesday from injuries he received when a piece of the mine fell from the ceiling while he was preparing to install a rib rolt.

The deadly accident happened at the Newtown Energy, Inc. Peerless Rachel Mine at Racine in Boone County.

This is the fifth fatal mine related accident in West Virginia in 2013.

BOONE COUNTY, W.Va. (WSAZ) -- A man died Wednesday night from injuries suffered in a mining accident in Racine, authorities say.

The man was a roof bolter at the Newtown Energy, Inc. Peerless Rachel Mine.
