UPDATE: Former Lewis Co. School Employee Arrested on Sex Charges

LEWIS COUNTY, Ky. (WSAZ) – A man who works for a school district in Kentucky has been charged with rape, after investigators say he was having sex with an underage student in his district.

Kasey Nolen, 38, worked for Lewis County Schools as a bus driver, technology coordinator and assistant sports coach. Nick Adams, director of district services, told WSAZ.com, though, that Nolen has resigned from all his positions with the district.

Nolen pleaded not guilty to his charges in court Tuesday morning. He faces a felony charge of third-degree rape, a felony charge of prohibited use of electronic communication to procure a minor, and a misdemeanor charge of distribution of obscene material. The arrest warrant alleges that Nolen sent photos of his genitals to the victim, a 17-year-old student at Lewis County High School. The arrest warrant and citation say the sexual relationship started in late February.

The district says a student came forward to alert administrators about what was happening on Friday afternoon and that they brought it to the Lewis County Sheriff’s Office right away. Investigators say they investigated throughout the weekend and had enough probable cause to obtain a warrant for Nolen’s arrest on Monday. Lewis County Sheriff Johnny Bivens tells WSAZ.com that Nolen was cooperative, turning over his phone to investigators and admitting to the relationship.

“It's unfortunate, obviously,” Bivens said. “We have determined it was a consensual relationship. You see the word rape and most people's perception is someone's been forcefully held against their will, and that's not the case in this one. What makes it a rape, third degree, is where Mr. Nolen held a position of authority, a position of trust.”

While investigators call the relationship consensual, the victim’s age is also a factor in the rape charge.

“As the law presents itself, at the end of the day, it's a crime and as the sheriff of this county, it's my duty to investigate and bring the proper charges,” Bivens said.

The district says Nolen has worked for Lewis County Schools since 2002 with no prior history of this type of behavior.

“We do background checks. If there's ever any kind of suggestion of any of our employees with anything like this, they're not going to be an employee long,” Adams said.

With daughters of his own, Adams tells WSAZ.com this is a difficult situation, especially in such a small community.

“I've got children of my own, I've got a job to do,” Adams said. “I'm going to take care of them, I'm going to do my job.”

Shortly after Bivens became sheriff, he said there was a similar situation with a teacher at another school in the county, charged with sending obscene material by cell phone. He said that teacher pleaded guilty and spent some time in prison. In this case, Nolen’s charges will be presented to a grand jury.

Nolen’s parents signed his bail Tuesday afternoon. Nolen told WSAZ.com he did not want to make a comment. He will be back in court for a preliminary hearing in early May.

LEWIS COUNTY, Ky. (WSAZ) -- A former employee at the Lewis County, Kentucky Schools is now behind bars accused of having an inappropriate relationship with a student.

Kasey Nolen, 38, of Vanceburg, was arrested Monday and charged with rape, prohibited use of electronic communication systems to procure a minor, and distribution of obscene matter to minors.

Lewis Sheriff Johnny Bivens says his office was made aware of allegations against Nolen on Friday afternoon by school administrators.

Nick Adams with Lewis County Schools tells WSAZ.com, "We had an employee involved in an incident outside school hours that resulted in our reporting to the Lewis County Sheriff's Office."

Sheriff Bivens says the relationship was consensual, but the victim is a juvenile.

Adams tells WSAZ.com that Nolen had been with the school district since 2002. He was an assistant girls basketball coach, assistant football coach, assistant district technology coordinator and webmaster for the school system and was a bus driver in the system.

Adams says Nolen has resigned from all of his positions with the district.

The school system is working with the Sheriff's Office.

Nolen is being held in the Lewis County Jail.

The case is expected to be presented to the Lewis County Grand Jury.
