LINCOLN COUNTY, W.Va. (WSAZ) -- A former bus driver in Lincoln County has been indicted on 20 counts of sexual abuse by a parent, guardian or custodian.
Rex Toney was arrested in June.
He is accused of inappropriately touching a student from Lincoln County High School on 20 different occasions -- while she was on the bus.
At the time of the arrest, Toney said he was innocent.
Toney drove a school bus for 34 years before resigning in 2011. One student claims he drove her to take legal action.
State police say surveillance video shows otherwise.
Although that driver faces 20 charges, he says he's innocent.

“The victim's claiming that there was physical contact between her and the bus driver, that the bus driver actually touched her,” State Trooper L.D. Hensley said.
"I never did any of the things to her she says I did,” Toney said.
Troopers say surveillance video from the school bus shows otherwise.
“The bus driver asked to touch her legs because it was cold, I suppose, that day and also he requested to bite her tongue,” Hensley said.
However, the surveillance video shows no physical contact -- making it her word against his.
State Police say Toney's preliminary hearing will be scheduled within the next few weeks. He is currently waiting for a court-appointed attorney.
The victim in this case claims that all of these incidents happened earlier this year.
According to the criminal complaint, Rex Toney is accused of inappropriately touching a girl on 20 different occasions while she was on the bus.
WSAZ.com spoke with Toney on the phone Tuesday morning. He says the girl is a student at Lincoln County High School and that he "never did any of the things to her she says he did."
Toney drove buses in Lincoln County for 34 years before resigning earlier this year.
He's currently waiting on an attorney to be appointed to him.
