FAYETTE COUNTY, W.Va. (WSAZ) -- The case against a police officer in Glasgow accused of buying drugs is moving forward.

The Fayette County Grand Jury has indicted Scott Wills on one count of possession of a controlled substance.

Police say Wills bought 30 oxycodone pills in Smithers back in April.

He has been suspended without pay since his arrest.

Wills will be arraigned on the charge Friday.

Scott Wills, 43, of Smithers, waived his right to a preliminary hearing. It was scheduled for Tuesday in Fayette County. Now a grand jury will decide if there is enough evidence to indict Wills on the charges.

Fayette County Sheriff's Deputies arrested Wills earlier this month after investigators say he bought oxycodone from a drug informant.

Until his arrest, he was the town of Glasgow's lead officer.

Wills faces several charges, including possession of a controlled substance with intent to deliver.

Wednesday Glasgow's lead officer, Scott Wills, was arrested after he was found buying oxycodone.

"The drug task force set up surveillance and we watched him. Yesterday evening he met with the informant, made the purchase and was arrested right after that," Fayette County Sheriff Steve Kessler said.

Wills is accused of setting up the drug deals from the police department this time and several deals before, once while in uniform.

“I certainly was surprised. You'd never think that out of a police officer. It's just hard to believe," Glasgow Mayor Charles Armstrong said.

The news has also left Wills department and co-workers shocked.

“When you hear that one of your supposed to be brothers is out here doing stuff like this it sheds a bad light on all of us," Glasgow Officer Steve Smith said.

"If he is guilty I just can't believe it. You work so much with somebody and you put your trust into them and everything, its betrayal," Glasgow Officer Aaron Roop said.

Now the Glasgow Police Department, made up of five officers, is down to two. Officer Steve Smith was shot last December and is out on medical leave recovering.

"It really bothers me that I get out here and almost lost my life doing a job that I love. And it turns out that one of brothers is out there doing something that I'm fighting so hard to get rid of," Smith said.

"It's the first thing you learn in the academy is brotherhood. And it's a shame that not everybody believes in that," Roop said.

Mayor Armstrong says he is in the process of recruiting new police officers he plans to interview his first candidate Friday.

Wills bond was set at $25,000.

No preliminary date has been set.

FAYETTE COUNTY, W.Va. (WSAZ) -- A Glasgow Police Officer is in jail on a felony drug charge.

According to a news release, on Wednesday the Fayette County Sheriff's Department, West Virginia State Police and officers from the Central West Virginia Drug Task Force set up surveillance on a house in the Smithers area of Fayette County.

An informant called Donald Scott Wills, also known as Scott Wills, 43, of Smithers, and asked him to come to this house and make a drug purchase and he agreed.

Deputies say Wills came to the house and bought 30 Oxycodone pills from the informant for $30 and told him he would pay the rest of the money he owed once he got rid of the pills.

Investigators witnessed the transaction.

Wills was confronted by officers as he was leaving the house, but deputies say he tried to hide the pills by throwing them into an adjacent yard.

The officer was in street clothes and was not operating a police vehicle at the time of his arrest.

"The illicit sale of prescription drugs is a major problem in southern West Virginia," said Sheriff Steve Kessler. "Law enforcement officers across the state are working diligently to put a dent in the drug trade. When you find a drug dealer masquerading as a police officer it is absolutely disgusting. Police officers are expected to hold to a much higher standard of conduct and the public has every right to expect that of us. This individual is a disgrace to the law enforcement profession."

Wills was charged with one count of possession of a controlled substance with intent to deliver. He will be arraigned in Fayette County Magistrate Court Thursday morning.

Deputies say Wills is currently employed by the Glasgow Police Department. He previously worked as a police officer for the Smithers Police Department.
