KANAWHA COUNTY, W.Va. (WSAZ) – The suspect of an early morning shooting Sunday turned himself in Thursday after felony charges were brought against him.

Delmar Dean Lacy II, of St. Albans, faces charges of malicious killing of an animal.

At Lacy’s arraignment he said the shooting “was an accident.”

Two horses were shot in that incident. One horse, Red House, was killed. Another named Cheyenne, who’s pregnant, was shot in the neck but survived.

Gary Medley, the owner of Honeysuckle Farms, has been caring for Cheyenne. He said she is recovering well physically but is saddened by the loss of the other horse.

“I think [the wound] is going to have to heal from the inside before it heals on the outside," Medley said. "This horse is a little depressed because we took it away from her that quick.”

Medley said the owners of the horse are grief stricken.

“That was her life them horses. She'd feed those horses before she'd feed her husband,” Medley said jokingly.

Since the shooting, Medley has received an outpouring of support from the community. He’s received as many as 100 calls inquiring about Cheyenne’s health. He said many of those callers expressed their anger over the abuse of an animal .

"There's a lot of people out there that love horses and animals," Medley said. "When you do something to an animal. They're going to come after you.”

Lacy posted his $500 bail Thursday.

KANAWHA COUNTY, W.Va. (WSAZ) -- The man wanted for killing a horse and injuring another in Kanawha County is behind bars.

Delmar Dean Lacy II, 39, of St. Albans, turned himself in early Thursday morning. Kanawha County Sheriff's Deputies charged Lacy with malicious killing of an animal.

The crime happened Sunday near Lower Falls Road in the St. Albans area.

According to the criminal complaint, deputies were called to Cassius Lane for a shots fired call. When they arrived, deputies say Lacy admitted to shooting his rifle "while celebrating his buddy's birthday."

Deputies say the stray bullets hit a building and fence where horses were living. The bullets killed a horse and injured another that was pregnant. That horse was shot in the neck, but survived.

31 shell casings were found in a yard, according to the complaint.

Originally, Lacy was cited for for discharging a firearm within 500 feet of a residence, but Thursday he was charged with a felony.

During the hearing, Lacy told WSAZ.com that it was an accident.

The magistrate set Lacy's bond at $5,000. Lacy told the magistrate someone was coming to post his bond.

Delmar Dean Lacy faces two counts of malicious harming of an animal, both of which are felonies. A second horse was injured in the shooting.

Deputies say about 5 a.m. Sunday, residents called Metro 911 about shots fired. Those shots resulted in the death of one horse. Another pregnant horse was shot in the neck but survived.

“It's pretty shocking to have an assault rifle going off in your neighborhood at 5 o’clock in the morning,” neighbor David Johnson said. “I believe the whole neighborhood was woken up. Lights turning on everywhere, it was loud.”

Shortly after deputies arrived, Delmar Dean Lacy was cited with shooting within 500 feet of a dwelling. Thirty-one shell casings were found in the area. Deputies say Lacy fired shots from a .223-caliber rifle.

“Although [deputies] saw one of the horses that was shot, the horse was upright and appeared to be in fine condition from across the field," Cpl. B.D. Humphreys said. "From their vantage point, they couldn't tell that it had been shot and hit and weren't able to see that the horse was injured.”

Neighbors said they can’t understand what would provoke such violence.

“I think it's awful. I mean, I can't understand why someone would be so mean,” said Elizabeth Coles, who has lived in the area for more than 15 years.

Johnson said his young daughter, a horse lover, is very upset about the death.

“Me and my little girl watch them come up and down the road,” he said. “She's a little mad about the situation; she cried.”

Deputies say more charges are expected against Lacy.
