LAWRENCE COUNTY, Ky. (WSAZ) – A man from Rush, Ky. has been indicted for murder in connection with a single vehicle crash that killed a passenger in his SUV.
The fatal accident happened on KY1, just north of Fallsburg, on May 20.
Sheriff's Deputies say 31-year-old Erick Blair was driving an SUV when he lost control in a turn and hit an embankment head on.
A passenger, Benjamin Burchett II, from the Diamond Ridge area of Lawrence County, died at the scene.
Another passenger, Amanda Burchett, of Louisa, was hurt and airlifted to a hospital in Huntington. Blair was also hurt in the crash.
Deputies said no one in the SUV was wearing a seatbelt and they believe that alcohol and drugs were contributing factors in the crash.
On Friday, a grand jury in Lawrence County indicted Blair for murder, 1st degree assault, 4th offense operating a motor vehicle under the influence, 1st degree driving DUI on a suspended license (aggravating circumstances), and failure to main required insurance.
An arraignment date has not been set in the case.

According to the Lawrence County Kentucky Sheriff's Office, the crash happened just after 5 p.m. on KY Highway 1, just north of Fallsburg.
Deputies say Eric Blair from Louisa was driving east when he lost control in a turn and hit an embankment head on.
Blair and passenger Amanda Burchett, also from Louisa, were both flown to St. Mary's Medical Center in Huntington. They are currently listed in stable condition.
Another passenger, Ben Burchett II, from the Diamond Ridge area of Lawrence County, was pronounced dead at the scene.
Deputies say no one in the SUV was wearing a seatbelt and they believe that alcohol and drugs were contributing factors in the crash.
The accident remains under investigation.
