ST. ALBANS, W.Va. (WSAZ) -- An 18-year-old man spent Valentine's night in jail after police caught him "in what appeared to be a sexual act" with a young girl.
Tristan W. Pennington, 18, from St. Albans has been charged with 3rd degree sexual assault.
St. Albans Police officers say Pennington and a 12-year-old girl were caught in a parked truck at the former Belvil Elementary School.
Police say texts had been exchanged between the two where Pennington asked her to have sex on Valentine's Day.
Pennington admitted to picking the girl up several block's from her parents' home.
He was arraigned Saturday morning and has been released on bail.
According to WV State Law, there must be less than a four year age difference even in consenting sexual acts when one of the persons is under 16 years old and the other is older than 16.
Pennington now faces one to five years in prison and/or a $10,000 fine. He may also have to register as a sex offender.
