KANAWHA COUNTY, W.Va. (WSAZ) -- The fallout continues as a result of the domestic battery case against Kanawha County Prosecutor Mark Plants.
A notice is now being given to everyone who is facing the same charge as Plants where the case involves an adult and child.
The goal is to make those in the case aware that Prosecutor Plants is under investigation and there is a potential conflict of interest.
Plants was arrested earlier this month accused of using excessive force when disciplining his son with a belt.
In addition to the notice there is also a copy of the petition filed by the Office of Disciplinary Council that recommends Prosecutor Plants be suspended from practicing law or disqualifying him and members of his office from these types of cases.
Lawyers on behalf of the city of Charleston have filed a motion to remove plants from all domestic battery cases within the city.
A hearing on that motion is set for Tuesday, April 22.
