UPDATE 6/12/13 @ 6:50 p.m.
KANAWHA COUNTY, W.Va. (WSAZ) -- Nine months after deputies say a puppy was tossed from a moving pickup truck, a man is charged with and accused of abusing the dog.

Timothy Loudermilk of Charleston was charged with animal cruelty. He was already in jail for meth-related charges in North Charleston.

Deputies in Boone County have been on the hunt for Loudermilk and say he and another man threw the puppy out of a window on a busy highway.

"You know, my brother's innocent on that charge. You know, we're animal lovers," the suspect's brother Danny Loudermilk said. "We've raised pit bulls our entire lives -- we would never throw no dog out of no truck."

Danny Loudermilk didn't want to discuss his brother's recent meth charges, although he says his brother would never hurt any pet.

However, deputies say last October that's exactly what happened. They were on patrol along U.S. Route 94 following a pickup truck and traveling at about 55 miles per hour. That's when they describe seeing a small puppy thrown from the right passenger's window.

Deputies say the black-and-white puppy could barely stand and was bleeding, so deputies rushed it to the animal hospital in South Charleston.

The puppy has since made a full recovery, and deputies say it was adopted to a good home. But now two men have to answer to what happened. Both Timothy Loudermilk and Scotty Thompson were charged with animal cruelty.

"It was an accident, and people are throwing it out of proportion -- you know if I had a dog, I'd give it to him right now," Danny Loudermilk said. "The dog jumped out of the back of the truck, that's all that happened."

His family says the puppy jumped out on its own. They claim Loudermilk was driving with a friend to Boone County to pick up an ATV.

Timothy Loudermilk was directly indicted on the charges.
