PRESTONSBURG, Ky. (WSAZ) -- The driver of car involved in a fatal car crash has been indicted for murder.

On December 12, a Floyd County Grand Jury indicted James Mace, 22 of Pikeville, on one count of murder and one count of assault in connection with an accident that killed Brenda Montgomery, 63, of Jackson, Ky., in May.

The crash happened on Ky. 114 in Prestonsburg.

Investigators say Mace’s car crossed the center line and hit Montgomery’s car head-on. Montgomery was taken to a local hospital where she died.

Mace, a passenger his vehicle, and a passenger in Montgomery’s vehicle were all hurt in the accident.

This is the second indictment for Mace related to the crash. In July another Floyd County Grand Jury indicted Mace and Jonathan Crider, 39, of Auxier, on two counts of wanton endangerment, receiving stolen property, fleeing and evading police, criminal trespassing and tampering with evidence.

Investigators with the Floyd County Sheriff’s Office say a short time before the fatal crash deputies had been pursing Mace’s vehicle after deputies spotted Mace and Crider allegedly stealing copper at an abandoned strip mine.

Crider was a passenger in Mace’s car at the time of the fatal crash.
