UPDATE 10/24/12
LOUISVILLE, Ky. (AP) -- Two mining officials who worked at an eastern Kentucky underground mine where a worker was killed last year are preparing to plead guilty to federal safety violations.

Records filed in U.S. District Court this week say Jefferson Davis and Joseph Miniard of Manalapan Mining Co. intend "to plead guilty rather than proceed to trial." The records do not offer details of the pending agreement.

A February indictment charged three men and Manalapan with June 2011 safety violations related to underground roof structures and hazardous conditions.

David Partin, who worked at Manalapan's P-1 mine in Harlan County, died when he was struck by a large section of rock on June 29, 2011.

The third defendant, Bryant Massingale, pleaded guilty to two charges in August. He'll be sentenced in January.

UPDATE 2/22/12
LONDON, Ky. (AP) -- A federal grand jury has indicted a coal company and three operators at a Harlan County mine where an underground miner was killed in a roof fall last year.

The 32-count indictment issued Wednesday in London charges Manalapan Mining Company and three officials with violating federal mine safety laws related to underground mine roof structures. It says the three officials -- the mine operations manager, superintendent and a foreman -- "failed to report and record hazardous conditions" at its P-1 mine in Pathfork.

The indictment says preshift records kept by the officials dating from June 13 to June 28 were falsified. On June 29, 46-year-old David Partin died at the P-1 mine when a mine roof collapsed.

A spokesman at Manalapan Mining did not immediately return a call Wednesday.

UPDATE 6/30/11 @ 1:20 p.m.
PATHFORK, Ky. (AP) -- A miner killed in an underground roof collapse has been identified by authorities.

Harlan County Deputy Coroner Jim Rich says the victim in
the coal mine accident on Wednesday was 46-year-old David Partin of Pineville.

Partin was working at the Manalapan Mining Co.'s P-1 mine in Pathfork when the roof caved in shortly before noon.

The mine has been closed, and officials from the Kentucky Office of Mine Safety and Licensing are investigating the incident.

It was the second fatality at a mine in Kentucky this year. Robert L. Cook of Inez died in March when he was pinned between a continuous miner boom and a mine wall at a mine in Martin County.
