UPDATE: No Additional Jail Time for Wayne County Man's Role in Murder

WAYNE,W.Va. (WSAZ) -- A man who helped a friend cover-up a murder will not spend additional time in jail after being sentenced Friday.

In June, Daniel Kilpatrick, 51, of East Lynn, pleaded guilty to being an accessory after the fact in the shooting death of Julius Davis, 51, of East Lynn.

Erica Dawn Streets, 31, of East Lynn,is charged with 1st degree murder in Davis’s death. Streets had two children with Davis.

Davis was reported missing by a friend in late August 2013. In early October, his body was recovered from a makeshift grave on his property.

State Police say Streets confessed to shooting Davis in the head with a rifle while he was in bed.

According to the criminal complaints, Streets told troopers that after she shot her “boyfriend” she called Kilpatrick to dispose of the body.

Troopers say Kilpatrick told them that he buried the body, cleaned the scene and burned evidence from the crime.

Friday afternoon, Kilpatrick was given a three year suspended prison sentence and was placed on probation for five years.

Judge James Young said that he had three factors in his decision: That Kilpatrick had a good work history, he had not been on drugs or alcohol, and that he had already spent more than 290 days in jail already.

During the hearing, Kirkpatrick took the stand and said he was trying to help a friend and made bad decisions.

Streets' trial is scheduled for this fall.

WAYNE, W.Va. (WSAZ) -- A Wayne County man has pleaded guilty to his role in the murder of East Lynn man..

In March, a grand jury indicted Daniel Kilpatrick, 51, of East Lynn, on one count of being an accessory after the fact to 1st degree murder in the shooting death of Julius Davis, 51, of East Lynn.

Prosecutors tell WSAZ.com that earlier this month Kilpatrick pleaded guilty to the charge. He will be sentenced next month.

The same grand jury indicted Erica Dawn Streets, 31, of East Lynn, for 1st degree murder in Davis’s death. Streets had two children with Davis. Her trial is scheduled for the fall.

West Virginia State Police and prosecutors say Davis was reported missing by a friend in late August 2013. In early October, his body was recovered from a makeshift grave on his property. Prosecutors say he may been killed in July 2013.

According to the criminal complaints, Streets told troopers that after she shot her “boyfriend” she called Kilpatrick to dispose of the body. Streets says when Kilpatrick arrived, she then took her children and left the home.

Troopers say Kilpatrick told them that he buried the body, cleaned the scene and burned evidence from the crime.

During Sheets preliminary hearing, a W.Va. State Trooper testified that Sheets said the shooting was because of past domestic violence incidences and that she was in fear of him hurting her or her children.
