HUNTINGTON, W.Va. (WSAZ) -- Charges have been dropped against a former special education aide at Central City Elementary in Huntington.
Lloyd G. Davis, 53, of Huntington, was indicted in December on a count of sexual abuse and a count of sexual abuse by a parent, guardian, custodian or person in a position of trust.
The charges stemmed from Davis allegedly inappropriately touching a 9-year-old student at the school last year.
Monday, the Cabell County Prosecutor's Office tells WSAZ.com that the charges were dropped without prejudice. They say that Davis can be charged again.
His trial was scheduled to start on Tuesday.
Earlier this month a Cabell County Grand Jury indicted Lloyd G. Davis, 57, of Huntington, on one count of sexual abuse, and one count of sexual abuse by a parent, guardian or custodian or person in a position of trust.
Huntington Police Detectives say the charges stem from an incident where Davis allegedly inappropriately touched a 9-year-old student at the school on November 22.
During Tuesday’s arraignment in Cabell County Circuit Court, Davis waived the reading of the charges. He is set to return to court for a pre-trial on February 16.

HPD detectives say these charges stem from a complaint of sexual abuse that happened November 22 at the school. According to the criminal complaint, the victim was 9-years-old.
Davis was arraigned before a Cabell County Magistrate on the charges.
He is currently in the Western Regional Jail
Cabell County Schools spokesman Jed Flowers said a mother claims her child was sexually assaulted last Tuesday by an employee at the school.
Huntington Police tell us the claim involves inappropriate touching.
Flowers says the employee is no longer at the school and will not be until the investigation is complete.
No one has been arrested.
