UPDATE: Mistrial Declared in Grayson Beating Death Case

GRAYSON, Ky. (WSAZ) -- A mistrial was declared shortly before midnight Tuesday for a Grayson man charged with manslaughter

Clifford Cathey, 35, was on trial for the beating death of 42-year-old Heath Toney, of Grayson, back on New Years Day in 2012.

Jurors got the case shortly after 3:30 p.m. Nearly nine hours later they told the court they were deadlocked and not able to reach a unanimous verdict.

In February, Cathey’s co-defendant, Bryan Rice, 39, of Grayson, pleaded guilty to a lesser charge of first-degree facilitation of manslaughter.

Rice received a five-year sentence with the understanding that he cooperate in Cathey’s prosecution.

But on Friday, Rice changed his story and testified as a prosecution witness that Cathey did not assault Toney.

There is no word if a second trial will take place.

Cathey is expected back in court next month.

GRAYSON, Ky. (WSAZ) – Jury deliberations are underway in the trial of a man charged with the beating death of a Grayson, Ky. man last year.

Clifford Cathey, 35, of Grayson, is charged with manslaughter in the death of 42-year-old Heath Toney, of Grayson.

The incident happened near the intersection of 4th Street and Robert and Mary Avenue in Grayson shortly before dawn on New Year's Day 2012.

In February, Cathey’s co-defendant, Bryan Rice, 39, of Grayson, pleaded guilty to a lesser charge of first-degree facilitation of manslaughter.

Rice received a five-year sentence with the understanding that he cooperate in Cathey’s prosecution.

But on Friday, Rice changed his story and testified as a prosecution witness that Cathey did not assault Toney.

The trial is taking place in Carter County Circuit Court.
