UPDATE 8/10/13
JACKSON COUNTY, Ohio (WSAZ) -- A woman has been indicted in connection with a deadly accident.

The Jackson County Prosecutor's Office says a grand jury has indicted Susan Canter, of Oak Hill, on two counts of aggravated vehicular homicide. Both charges are felonies.

The charges stem back to June, when the Ohio Highway Patrol says Canter was turning onto Slab Hill Road off of State Route 279. Investigators say Canter turned in front of an oncoming truck.

Her uncle, 75-year-old David Evans, of Oak Hill, died in the crash.

Canter's boyfriend, 48-year-old Wilbur Johnson, of Gallipolis, was also in the vehicle.

Investigators say alcohol could have played a role in the crash.

After her arrest, Canter told WSAZ.com that the day of the crash, she had been drinking and had smoked marijuana, but that it was several hours before the crash and that she was not drunk at the time.

UPDATE 6/3/13 @ 2:45 p.m.
JACKSON COUNTY, Ohio (WSAZ) -- The driver of car involved in a deadly crash that killed her uncle has been charged with felony vehicular homicide.

The two-vehicle crash happened on State Route 279 near Oak Hill, Ohio, Sunday afternoon

The Ohio State Highway Patrol says Susan Canter, 39, of Oak Hill, Ohio, failed to yield while making a left turn onto Slab Hill Road and was hit by the driver of a GMC pickup.

Canter’s uncle, David Evans, 75, of Oak Hill, Ohio, was a passenger in her car and died at the scene.

Another passenger, Wilbur Johnson, 48, of Gallipolis, was flown to Cabell Huntington Hospital in Huntington where he is listed in serious condition.

Canter was arraigned on the charge Monday in Jackson County Municipal Court. Additional charges of OVI and driving on a suspended license are pending, according to court officials.

"I am so sorry for what happened to my uncle," said Canter as she was being escorted from court. "I should not have been driving without the proper license."

Troopers say they suspect alcohol played a factor in the crash and are awaiting lab results from urine analysis.

Canter says she's not guilty of the OVI charge. Canter is being held in the Middleport, Ohio Jail in lieu of a $250,000 bond.

Canter's preliminary hearing is set for June 10.

The driver of the pickup suffered minor injuries. His passenger was also hurt, and taken to a hospital in Jackson Ohio.
