UPDATE: Athens County Man Enters Plea in Homicide Case

ATHENS COUNTY, Ohio (WSAZ) -- A man entered a no contest plea Tuesday in a homicide case involving the shooting death of a man in June he said was an intruder, according to information from the Athens County Prosecutor's Office.

Randy D. Richmond, 39, of Glouster, Ohio, appeared before Judge George P. McCarthy on charges of reckless homicide and negligent homicide. Richmond was charged in the death of Keith Rutter, 33, whose body was found in brush off Taylor Ridge Road in Glouster.

The shooting happened June 20. Richmond called Athens County 911 to report he had shot an intruder with a .22 rifle.

Athens County Sheriff Pat Kelly said Rutter was shot and killed after he exited a home.

Witnesses told Sheriff's detectives that Rutter was seen walking up the road in front of the burglarized residence, then cutting over the hill next to the residence.

Investigators say Rutter lived in the home directly across the street from the home he was accused of burglarizing.

Richmond’s plea will be held in abeyance for up to three years, meaning it will be a part of his record. He was ordered to remain a law abiding citizen, complete 60 hours of community service, pay restitution in the amount of $1,000, make monthly contact with a supervising officer and pay court costs.

Should Richmond violate any of these conditions, he could face a five-year prison term.

ATHENS, Ohio (WSAZ) -- The Athens County Sheriff says the investigation following the shooting death an alleged home burglar has solved more than a dozen burglaries and break-ins in the area.

The incident happened last month at a home along Taylor Ridge in Glouster.

Sheriff Pat Kelly says 33-year-old Keith “PJ” Rutter was shot and killed by a relative of the homeowner after he allegedly exited the house.

Investigators say Rutter lived in the home directly across the street from the home he's accused of burglarizing.

Sheriff Kelly said on his Facebook page Tuesday that the burglaries and break-ins happened along State Route 550, State Route 13 and Taylor Ridge areas.

Kelly says multiple items have been located, and detectives are in the process of contacting residents to identify their property.

He also says that Rutter pawned a number of the items. Other property can’t be located due to no serial numbers and other issues.
Below is a list of items that were pawned at local pawn shops and are unaccounted for property, according to Sheriff Kelly:

  • Remington 870 20 Gauge Shotgun
  • Husqvarna Chainsaw
  • Mossberg 12 Gauge Bolt Action Shotgun
  • H&R Pardner 410 Shotgun

Also the following were pawned and are no longer available property, but still unaccounted for:

  • Foreign 50-cent coin
  • 10 Karat Ring
  • 10 Karat Ring
  • 14 Karat Bracelet
  • 14 Karat Rope Chain with Gold Ring
  • 10 Karat Flat Chain
  • Old Carbide Light
  • 1922 Silver Dollar
  • Buffalo Coin

The name of the shooter has not been released. There is no word if any charges will be filed.

ATHENS, Ohio (WSAZ) -- The Athens County Sheriff says a grand jury on Monday did not hear the case of a home burglary where the alleged burglar was shot and killed.

The incident happened at a home on Taylor Ridge in Glouster last Thursday.

Sheriff Pat Kelly says 33-year-old Keith “PJ” Rutter was shot and killed by a relative of the homeowner after he allegedly exited the house.

Witnesses told Sheriff's Detectives that Rutter was seen walking up the road in front of the burglarized residence, then cutting over the hill next to the residence.

Investigators say Rutter lived in the home directly across the street from the home he's accused of burglarizing.

The name of the shooter has not been released.

Sheriff Kelly said the prosecution needed more evidence before bringing the case to grand jury.

The Athens County Prosecutor’s Office tells WSAZ.com they have no comment on the case.

Sheriff Kelly says 33-year-old Keith Rutter was shot and killed by a relative of the homeowner after he exited the house.

Witnesses told Sheriff's Detectives that Rutter was seen walking up the road in front of the burglarized residence, then cutting over the hill next to the residence.

Investigators say Rutter lived in the home directly across the street from the home he's accused of burglarizing.

The family that lives in the home that was burglarized declined to comment Thursday evening.

Rutter's family declined to comment also.

The name of the person who shot Rutter is being withheld pending the outcome of the investigation.

Investigators will have to determine whether the shooter was within their rights to shoot the suspect.
