UPDATE: Otway Man Found Not Guilty of Murder

PORTSMOUTH, Ohio (WSAZ) – A jury has found a Scioto County man not guilty of murder.

Terry Shepherd, 35, of Otway, was on trial for the shooting death of Carl Tackett Jr., 30, of Rarden, in March 2012.

The Scioto County Common Pleas Court Jury deliberated for about four hours Thursday afternoon before reaching the not guilty verdict on all four counts --- aggravated murder, murder, voluntary manslaughter, and felonious assault.

Scioto Prosecutor Mark Kuhn says the judge explained the self defense option to jurors before deliberations began.

The shooting happened at Shepherd’s home on Dodds Road in Otway. Investigators say Tackett was found dead in the driveway of the home.

Following the shooting, Sheriff Marty Donini said Shepherd had been in a verbal argument with Tackett, when Shepherd pulled out a handgun and shot Tackett multiple times.

Kuhn says Shepherd’s attorney used self defense as the reason for the shooting.

Back in January the case went to trial, but the judge declared a mistrial after two separate incidents with jurors.

Terry Shepherd, 35, of Otway, is charged with the shooting death of Carl Tackett Jr., 30, of Rarden, in March 2012.

Back in January the case went to trial, but the judge declared a mistrial after two separate incidents with jurors.

The shooting happened at a home on Dodds Road in Otway. Investigators say Tackett was found dead in the driveway of the home.

Following the shooting, Sheriff Marty Donini said Shepherd had been in a verbal argument with Tackett, when Shepherd pulled out a handgun and shot Tackett multiple times.

The trial is taking place in Scioto County Common Pleas Court.

SCIOTO COUNTY, Ohio (WSAZ) – A mistrial has been declared in a Scioto County murder trial.

Terry Shepherd, 35, is charged with murder in the shooting death of Carl Tackett Jr., 30, of Rarden, in March 2012.

His trial began Monday morning, but ended on Thursday with the judge declaring a mistrial.

Prosecutor Mark Kuhn tells WSAZ.com the judge made the decision following two separate incidents with jurors earlier in the week.

The shooting happened at a home on Dodds Road. Investigators say Tackett was found in the driveway of the home.

Following the shooting, Sheriff Marty Donini said Shepherd had been in a verbal argument with Tackett when Shepherd pulled out a handgun and shot Tackett multiple times.

A new trial date has not been set.

SCIOTO COUNTY, Ohio (WSAZ) – A jury picked for the trial of Otway man charged with murder is visiting the scene of the alleged crime.

Terry Shepherd, 35, is charged with murder in the shooting death of Carl Tackett Jr., 30, of Rarden in March 2012. His trial began Monday morning with jury selection in Scoto county Common Pleas Court.

The shooting happened at a home on Dodds Road. Investigators say Tackett was found in the driveway of the home.

Following the shooting, Sheriff Marty Donini said Shepherd had been in a verbal argument with Tackett when Shepherd pulled out a handgun and shot Tackett multiple times.

Monday afternoon, the jury and court officials traveled to Otway to look at the crime scene. Before that, opening arguments were held in the case.

Court officials tell WSAZ.com that they expect several witnesses to testify once everyone returns to the courthouse.

SCIOTO COUNTY, Ohio (WSAZ) -- A man has been indicted for a murder that happened in March in Otway, Ohio.

Terry Shepherd, 35, of Otway, was indicted this week by a Scioto County Grand Jury on charges of aggravated murder, murder and felonious assault/firearm suspicion.

Shepherd was arrested last month after a shooting on Dodds Road.

Investigators say Shepherd shot and killed Carl Tackett Jr., 30, of Rarden.

He was found dead in the driveway of the home.

Sheriff Marty Donini says Shepherd had been in a verbal argument with Tackett when Shepherd pulled out a handgun and shot Tackett multiple times.

ORIGINAL STORY 3/9/12 @ 8 a.m.
SCIOTO COUNTY, Ohio (WSAZ) -- A man has been arrested in connection with a murder in Otway Thursday afternoon.

Sheriff Marty Donini says the fatal shooting happened at 376 Dodds Road about 4:30 Thursday afternoon.

When deputies got to the scene they found the victim Carl Tackett Jr., 30, of Rarden, dead in the driveway of the house.

Sheriff Donini says 35-year-old Terry Shepherd of the Dodds Road residence was arrested at the scene and charged with murder.

The Sheriff says Shepherd had been in a verbal argument with Tackett when Shepherd pulled out a handgun and shot Tackett multiple times.

Shepherd is being held in the Scioto County Jail. He is set to be arraigned in Portsmouth Municipal Court later Friday.
