UPDATE 5/24/12 @ 2:45 p.m.
LINCOLN COUNTY, W.Va. (WSAZ) -- The names have been released after a shooting in Lincoln County Wednesday night.
The shooting was reported around 8:15 p.m. on Compas Point off of Mud River Road in Lincoln County.
According to the Lincoln County Sheriffs Department, when they got on scene they found Fulton Toney with gun shot would to the stomach, leg and arm.
Brian Maynard from Harts, West Virginia was arrested for the shooting. Maynard admitted to deputies that he shot Toney.
Deputies say Toney walked to Maynard's home and asked him to turn down his radio because it was too loud and he getting ready to go to bed.
That's when deputies say Maynard pulled a shotgun out of his vehicle and shot at Toney's feet. The buckshots hit Toney in several locations.
According to the criminal complaint, Toney pulled a pistol out of his pants and fired a round at Maynard. The bullet did not hit him.
Toney returned home and had his wife call 911.
Toney was taken to CAMC where he was treated and released.
Maynard was arrested and is charged with malicious wounding and brandishing.
Deputies say at this time Toney will not be charged. They say he fired in self-defense.
It was reported about 8:30 p.m. along Bulger Road.
There’s no word on the man’s condition.
