UPDATE: Man Charged With Murder After Wayne Co. Shooting

CRUM, W.Va. (WSAZ) – More details have been released about a deadly shooting in Crum early Saturday morning.

S.G. Poff with the Wayne County Sheriffs Office says the murder happened about 12:45 a.m. at a mobile home in the 2900 block of Riverbend Road in Crum.

Investigators say Brien Scott Bays, 42, of Crum, shot and killed Richard Laney, 57.

They say Laney was standing in his doorway when he was shot in the chest and abdomen.

Following the shooting, investigators say Bays left the area on an ATV. Investigators with the Wayne County Sheriffs Office, West Virginia State Police, and US Marshals arrested Bays at his home about 11 a.m. Saturday.

Laney’s wife, Maria, tells WSAZ.com that when she went to bed her husband was across the street with friends. The next thing she heard were gunshots.

“I heard two or there shots and I woke up," said Laney.

Poff tells WSAZ.com that Bays was intoxicated at the time of the shooting.

According to the criminal complaint, a witness said Bays was at his residence waving a revolver and trying to get others to drink moonshine. The witness also said that Bays wanted someone to take him to a store in Crum to get beer and cigarettes.

At that point, the witness said he asked Bays to leave. He said Bays backed his and buggy (ATV) out of the driveway and tried to start it, but it would not start. About 10 minutes later, the witness said he heard two guns shots and then saw Laney lying in his doorway.

According to the criminal complaint, two spent 410 gauge shell casing were found in the road.

A .22 revolver with one spent casing was found in Laney’s doorway. Investigators said they believed that gun belonged to Laney.

“There was no argument at all. He was just an accident waiting to happen and Richard was just at the wrong place wrong time," said Danny Williams, Laney's brother-in-law

Bays is being held in the Western Regional Jail. His preliminary hearing is set for Wednesday.

CRUM, W.Va. (WSAZ) -- A man has been arrested and charged with murder in connection to a fatal shooting that happened in Crum.

S.G. Poff with the Wayne County Sheriffs Office says the murder happened about 12:45 a.m. Saturday at a mobile home on River Bend Road in Crum.

Investigators say Brien Scott Bays, 42, of Crum, shot a man who lived at the home twice in the chest and abdomen area. They say the man was standing in his doorway when he was shot. His wife was in another room sleeping.

The man died at the scene. His name has not been released.

They say Bays left the home on an ATV.

Saturday, investigators with the Wayne County Sheriffs Office, West Virginia State Police, and US Marshals executed a search warrant at Bays home.

He was arrested and charged with murder.

Poff tells WSAZ.com that Bays was intoxicated at the time of the shooting.

He is expected to be arraigned early next week.
