MINGO COUNTY, W.Va. (WSAZ) -- Three years after a baby died, the mother has been charged in the death.
Jennifer Lynn Harmon, 42, of Newtown, in Mingo County, was arrested Monday on child abuse resulting in death.
According to the criminal complaint, the incident happened on September 20, 2010.
Harmon told Mingo County Sheriff's Deputies that she drank six beers, then went to bed, according to the criminal complaint. She told them she slept in the same bed as her 1-month-old son Brier Harmon.
According to the complaint, she said she woke up around 4 a.m. and found the baby had passed away.
According to the medical examiner report, which was just released last month, "The cause of death was due to accidental overlay associated with bed-sharing with an adult caretaker who disclosed having abused alcoholic beverages on the night prior to the child's death."
Her family says her real punishment is living the rest of her life knowing what she did.
"She's had to live with herself, so I think that's enough punishment," Jennifer’s cousin Walter Harmon said.
The family is wondering why it took the medical examiner's office three years to reach this conclusion.
"It is odd for it to have taken this long to figure out what happened and why they're doing anything now," cousin Misty Ingersoll said.
Harmon is being held on a $25,000 bail.
