UPDATE 12/31/13 @ 10:30 p.m.
CHARLESTON, W.Va. (WSAZ) -- For the family of 55-year-old James Allen Ward, the New Year will begin with a major void.

“Not how we wanted to start the night off,” Charleston Police Cpl. Brian Jones said.

About 4:30 p.m. Tuesday, Ward tried crossing the southbound lanes of the Patrick Street Bridge and was hit and killed by a truck.

“Tried to walk in between the truck and the trailer and fell down and was struck and was killed instantly,” Jones told WSAZ.com.

Officers say Ward was not walking in the crosswalk and that the driver, who was hauling construction equipment, had the right-of-way and will likely not face charges.

“Everybody needs to be cautious driving,” Jones said.

Officers say, while the area is not a problem spot for crashes, both drivers and pedestrians should be alert while traveling near the busy bridge.

Charleston Police say Ward was homeless but had family in the Charleston area.
