CATLETTSBURG, Ky (WSAZ)-- A judge has reduced the bond for the man charged with murder in a fatal DUI crash.
21-year old Billy Joe Barker is charged with death of Russell Bellomy.
The 71-year old died after the motorcycle he was operating was struck by a truck driven by Barker. Police said the truck crossed the center line on Blackburn Avenue near Oakview Elementary School in Ashland.
A passenger on the motorcycle, 12-year-old Kristoffer Calloway, was critically injured. He remains in the hospital today.
During a hearing Tuesday in Boyd County Circuit Court, Judge David Hagerman reduced Barkers' bond from $150,000 to $100,000.
Barker's attorney had asked the bond be reduced to $35,000.
Hagerman also set Barker's trial for December 2.

ASHLAND, Ky. (WSAZ) -- A 12-year-old boy who was seriously injured in a motorcycle accident last week is getting better Wednesday.
Kristoffer Calloways' father called us Wednesday evening and said Kristoffer was taken off life support and is breathing on his own. Kristoffer was hurt Friday night in the crash when police say Billy Barker collided head on with the motorcycle Kristoffer was riding.
Kristoffer's grandfather Russell Bellomy was killed in the accident. He was buried Wednesday afternoon. Police say Barker was drunk when the accident happened. He pleaded not guilty to murder, assault and DUI charges earlier this week.
Kristoffer remains in critical condition, and doctors say there is a possibility one of his legs may have to be amputated. He also had suffered head trauma.

CATLETTSBURG, Ky. (WSAZ) -- Ashland resident Billy Barker pleaded not guilty Monday to murder in connection with a Friday night traffic accident that killed a 71-year-old missionary known throughout the world.
Barker, 21, also pleaded not guilty to assault and DUI charges. Russell “Rusty” Bellomy, 71, died after a motorcycle he was operating was struck by a truck driven by Barker. Police said the truck crossed the center line on Blackburn Avenue near Oakview Elementary School in Ashland.
A passenger on the motorcycle, 11-year-old Kristoffer Calloway, was critically injured. He suffered head trauma and serious leg injuries. His most recent condition was described as critical but stable.
Barker's arraignment at the Boyd County Courthouse was so emotional that Barker's wife hugged Bellomy’s daughter. She said her father recently had returned from a mission trip to Jamaica and had taken his grandson Kristoffer along for a learning experience. Bellomy had spent nearly 30 years spreading Christianity throughout the nation and world.
Commonwealth Attorney David Justice said Barker's murder case will proceed to a grand jury as early as Friday.

CATLETTSBURG, Ky. (WSAZ) -- The Boyd County Commonwealth Attorney has filed a murder charge against the driver of the truck involved in what police say was a fatal DUI crash late Friday.
21-year-old Billy Barker was served with a murder warrant in his jail cell early Monday morning.
His arraignment is set for 1 Monday afternoon.
Barker is being held in the Boyd County Detention Center on $1 million bond.

ASHLAND, Ky. (WSAZ) -- A man on a motorcycle died and a 12-year-old passenger was severely injured after an accident involving a man suspected of DUI late Friday evening in Ashland.
The accident happened on Blackburn Avenue in front of Oakview Elementary School. That's between Jackson and Adams Avenues.
Captain Todd Kelley with the Ashland Police Department says the driver of a pickup truck, 21-year-old Billy Barker, was intoxicated. He crossed the center line and hit the motorcycle head-on.
Police say Russ Bellomy was killed. His grandson Kristoffer Callaway was listed in critical condition at Cabell Huntington Hospital Saturday night.
Kristoffer will be a 6th grader at Rose Hill Christian School.
Barker was arrested on the scene. He was first taken to King's Daughters Medical Center in Ashland for treatment and for blood testing. He's now in the Boyd County Detention Center.
Barker is charged with operating a motor vehicle under the influence of intoxicants. However, he will likely face more severe charges, according to police.
Ashland Police and the Commonwealth's Attorney are investigating.

ASHLAND, Ky. (WSAZ) -- A man on a motorcycle died and a young passenger was severely injured after an accident late Friday evening in Ashland.
It happened on Blackburn Avenue in front of Oakview Elementary School between Jackson and Adams Avenues.
Captain Todd Kelley with the Ashland Police Department said the driver of a pickup truck was intoxicated. The driver crossed the center line and hit the motorcycle head on.
The driver was dead when emergency crews arrived on the scene.
The young passenger has severe injuries and was taken to a Huntington-area hospital.
The driver of the truck was arrested on the scene and charged with operating a motor vehicle under the influence of intoxicants.
The driver will likely face more severe charges.
Ashland Police and the Commonwealth's Attorney are investigating.
