Man Gets Jail Time for Giving Inmate Snack Cake Save Email Print

McARTHUR, Ohio (WOUB) -- A judge has sentenced a man to 30 days behind bars in the Vinton County snack cake case.

21-year-old Timothy Caudill was accused of breaking the rules when he gave a Little Debbie snack to another man at a residential corrections program.

Caudill was looking at nine months in prison for the infraction, but Judge Jeffrey Simmons let him off with a month in jail.

Simmons found that Caudill "is amenable to continued community control" -- and noted that he has a job.

He's to start serving his 30 days on Monday and he has to reimburse Vinton County $1,500 for the cost.

Caudill was originally jailed for breaking and entering and was placed at the SEPTA Correctional Facility in Nelsonville.

My kid took a little debbie cake last night without permission. She knows she can't have them after 6pm. Think I'll fine her $1500.00 since the precedent has been set. I could use the money for some projects. O yeah and now she has to stay inside for 30 days also.

I wonder how often these instances take place, and the usual punnishment. The man was already incarcerated for B&E, so was supposed to be following rules. While what he did shows compassion, he deliberately disobeyed that facility's rules, and should be repremanded in some manner. I am sure this happens more frequently than we are given knowledge of, but I would love to know what the standard punnishment is. We really weren't given the information to know if this is actually a normal procedure, or if he received a more harsh punnishment (because it was a BIG Oatmeal cake like that other man said). Personally, I agree with everyone here that thinks this is stupid, but I am just trying to see the other sides point of view. ???????

This guy was given a gift--a second chance. He repeatedly and deliberately broke rule after rule, thumbing his nose at us, the taxpayers. Sharing a treat sounds like a petty offence but it was part of his pattern of behavior. Breaking the big rules got him into trouble; breaking the small ones will keep him there.

I agree with VC Citizen, Gleeson is on a power trip. He is up for reelection this year and it will be a shame if he gets elected again. Vinton County is a good place to live if you can stand the embarrasment that the judicial system has brought to us in the last few years.We made the national news a few years back when a judge and our prosecutor decided that a murder suspect couldn't be tried because there was no money to pay for the legal proceedings. STUPID!STUPID!STUPID! Gleeson wanted to give Mr.Caudill 9 months for his "crime" but you have to give the judge credit for his "judgement" of 30 days.Good luck sharing any Little Debbies in jail in Ohio!!!!!!!!

We need to free more killers, rapists, thieves and other miscreants so that we can put compassionate, snack cake-sharing folks in prison. The prosecutor and judge should be placed in the middle of town with a "kick me" sign prominently placed on their bodies. Ridiculous.

Once again I am embarassed to be originally from Ohio. Never in my life did I ever think I would say those words, however I have found myself saying quite a bit lately. This is the absolute most ridiculous thing have ever heard. Some of the most violent people are running the streets of Ohio (some of my own family members) and have never gotten more than 30 days in jail for the horrible crimes committed. This guy SHARES a snack cake and gets 30 days!? I hope every Ohio voter remembers this. Simmons, you better be finding another job because providing justice to the Ohio community is definately not up your alley. One of these days someone with throw the "snack cake" at you.

Lawmakers talk about the overcrowding of jails that desperately needs addressed, and then you see something like this happen. Absolutely amazing! If there was no crack cocaine or pills inside that creamy filling, then for God sakes let the man alone! The sheer ingnorance of our judicial system sometimes leaves me speechless. Imagine the guy talking to other inmates... Inmate#1: hey, i'm in here for theft. Inmate#2: well I'm in here for drunk driving. Inmate#3: well I'm in here for assault. (one of the imates turn to Mr.Caudill) What are you in for? Mr.Caudill: smuggling a Little Debbie cake into the jail, so don't mess with me! This whole thing is laughable, and this judge who sentenced him should concentrate on locking up criminals who have broken real laws that are governed by society. Can't complain about overcrowding while allowing this moron to sit on the bench!

this is so stupid, are you serious..Ohio?? Tax payers are going to pay for a man to be jailed for another 30 days for giving some one a snack cake.? Their are mothers here in Portsmouth letting people abuse and kill their children also leaving them unattended and the child dying..and there isn't any thing done about it.... but a man can give another man a snack cake and get jail time and a huge fine from it...the laws in Ohio are the stupidest and the cops and judges are worthless...people involved in this sentencing outta be ashamed of them selves.

This is the most assanine thing I have ever heard of. You get arrested for selling drugs, you pay your bond and you are back out on the streets selling again. But, lets not break the law of giving someone a snack cake, instead lets sell cocaine, heroing, pot, oxys, loratabs, etc to our children. Our Judicial system is the biggest joke. This has got to be one of the stupidest judges in the country. Lets see a man rapes and murders a mother and her two daughters he cries to the courts that he won't get a fair trial please move it to another county so I can try to fool them into thinking I'm innocent. Another guy with a drunken driving record gets to steal a truck and kill four innocent people after what is it 30 priors? The poor guy from this story gives a guy a snack and gets jail time. Aren't we taught in kindergarten that its NICE to share??? Too bad he didn't give the guy a joint or a hit of cocaine then he'd be home free. Where's the person who originally posted on this thread when this story first came out..I LOVED what they said...they said something to the effect that they were mugged in Huntington by a Little Debbie Cake & they took their user fee! Now THAT I loved. THAT was funny. THIS real sentence is NOT funny though. STUPID, STUPID, STUPID! I posted earlier under "what a stupid judge". After reading your posts, I see I'm not the only one fed up with this "overcrowding" in jails crap! This guy didn't STEAL the cake for heavens sake, he bought the thing. It is hard to take pride in our state if we have a bunch of stuff like this going on. we have one man on death row wanting to die. and the courts just drag there feet never geting the right people to justice. this guy gets 30 days and $1500 fine. it costs the taxpayers more than that to keep this guy in jail.these judges need to get there ducks in a row.

The guy keeps breaking the rules. That's what it's all about. The only way one can give an inmate anything; food, clothing, whatever; it has to be approved by the Warden. You can't just bring anything in to the inmate without permission. There could have been a razor blade inside the cake. He broke the law. Now he has to pay.

granted it is very stupid that they are giving him time for a snack cake but there are reasons behind the judgement. the correctional system is affraid that the snack cakes will have things such as drugs or weapons hidden inside of them, thus the rule of no sharing. it is a pretty common rule and inmmates are aware of it and the punishment for the infraction.

Nothing suprises me anymore. Does this mean that I'm going to be sentenced to jail time if I give my husband a snack cake? UUHHMMM....right! I can remember our church group taking snack cakes to the county jails to the inmates there. I just give up. WE, as law abiding citizens, have no rights anymore. Those have all been given away, one at a time, to the criminals, etc. No wonder so many people turn to a life of crime and drugs. There's no punishment. But if you .....oh never mind!

I wonder if Timothy Caudill had given the snack cake to an ILLEGAL IMMIGRANT if he would have been given any jail time or even a fine? It was so nice of the judge not to give him the FULL NINE MONTHS! Maybe he wanted to save room for the rapists,murderers, terrorists, or illegal immigrants that might need the space later. As for the fine, I wonder how many of the above mentioned criminals have been made to make restitution to any one for anything? The guy that was convicted of holding his daughter prisoner, raping her, and even fathering children by her, only got 15 years. WHAT IS WRONG WITH THIS PICTURE?!!!!

I'm a retired Police Officer,and I have never heard of anything like this before. Someone needs to look at this Judge's record to see how many real criminals he has given light sentence's to. Like drug dealers, drunk drivers; things like this. I could see doing this if this guy passed drugs or something. The citizens of that community need to elect a new Judge. Stupid,Stuiped Judge!!!!!

Everyone acting like it is so bad for him to get jail time. Take in the fact that he has been in jail for awhile, for breaking and entering. He broke the rules when he was thieving, as well did he break the rules by giving a debbie cake. Leave him there for a year for all I care!

This is utterly rediculous, "Man Kind Enough to Share gets 30 days in Jail". Just shows how much people like to waste the tax payers dollars. As far as the system goes its clearly corrupt you not innocent until proven guilty, if that was the case we wouldn't have innocent people in jail. I mean did anyone see where they let the guy out of prison after he had spent like 30 years in there for a crime he didn't commit, yeah they let him free because DNA proved it wasn't him. Guilty until Proven Innocent. The Judicial system is a piece of crap!

how stupid can they be first they let the police off of serious crimes and police brutality and then there going to send some one to jail for not letting someone go hungery i think our goverment needs to do some soul searching in there hearts and get back to the basics of life because if they dont then know one will either just because there in jail they should not go hungery

I would LOVE to see this story featured on a national news program as a perfect example of our judicial system run amok. The celebrities in our culture get out of jail after serving a matter of hours or days for much more serious offenses such as DUI. Murderers and sexual offenders are placed on probation or paroled, but this unfortunate fellow gets the book thrown at him. This takes the cake, pun intended!

this has got to be the most outrageous thing i have ever heard of geeze... now folks dont tell our children to share because they could end up in jail.. guess the judge dont like sharing ... um he could also not like little debbie snack cakes.. eeeek i better not say that i may end up in jail for attempted of snack cakes...

I agree. Let the rapists and murderers wander the streets looking for their next victim without getting caught, but arrest the snack cake thief and give him time in jail. This is ridiculous.

This is a perfect example that something like this will get you jail time, when in Ironton a relative of the county auditor and the county sheriff steals $26,000 from taxpayers and only gets probabtion! UNREAL!!!
