NEW BOSTON, Ohio (WSAZ) – Police say a man has died nearly two weeks after being involved in a fight outside a bar in New Boston, Ohio.

51-year-old John McDaniel died Saturday at a Hospice facility in Portsmouth. Police have now charged 27-year-old Joshua Howerton with voluntary manslaughter.

The fight happened outside the MT Bar and Carryout back on August 6. Police say that McDaniel did not seek treatment at a hospital after suffering what appeared to a minor visible head injury.

Investigators say the next day McDaniel’s condition got worse and he was taken to a local hospital where he was admitted to the intensive care unit.

Howerton was arrested on Monday. He is scheduled to be in court on Tuesday.

to jenny he may not meant to kill the guy but he did...he should pay for what he has done.......takes 2 to tango???? and what the heck does Yahoo got to do with a fight at the bar????it sounds like u had a share of yahoo who evers..lol

You know, in my opinion, they are wrong with the charge of VOLUNTARY manslaughter, moe like Negligent homicide. Howerton did not voluntarily kill this man, it was not planned. In the heat of the moment, they fought, which some idiots do when they are drinking. If you cannot handle your liquor, DON'T DRINK! Number 2, it takes 2 to tango. I am sorry this man lost his life, but you know, it was just his time to go, flat out, plain and simple. I'm sorry for the families loss, but neither man is innocent. You know alcohol is evil, flat out! Does good come from Satan juice? No...There are those I guess who like to go out drink, get hung over, waste their money, take some yahoo come whom they have just met (who has who knows what), or end up like these two men. Now really is it worth this? This could happen to anyone by being in that type of environment. No good comes from drinking, no good at all. On another note, they do need to get their charges straight, and their facts....Sad, sad....

someone dies as a direct result from an injury received from a fight...neither the family nor the victim has to file charges...the law takes over here...ie domestic violence laws dont require a victim to file charges...if law enforcement sees physical evidence...then charges are filed...he died...the guy was in his 50's and the other guy late 20's...they should not have been fighting...and we dont know all the details...maybe he was caught off guard...or asulted

The guy did not press charges, it clearly says he did not go to the doctor for his head injury but the next day he took a turn for the worse and there for went to the doctor. now it could have been his family that pressed the charges. i understand that they both were willing to fight and both disrespected the other, but it's different when someone dies from the result of it.

I agree with cc..I also remember when you could go out and have a good time with friends at the local bar. Sure, you had a scuffle here and there, but not like it is today. Now if you go to certain places, you are literally taking your life into your own hands. I no longer frequent the bar scene and just have a drink at home. At leaat I know I will be safe.

i couldnt agree more with chris. it was fun to go out to bars once upon a time. but do to drug abuse or whatever, people have changed for the worse. and you just cant go out anymore tto have a few drinks with friends or dance or just unwind from a long hard work week.people just want to cause trouble anymore for whatever reason.and this is happening in everywhere. WHATS WRONG WITH PEOPLE?!?!?!

That is just not right, if two men can not fight anymore without someone being charged something has got to be done! I am sure that both guy's had a mutal responsibility in the fight so what's the big deal !! I could see if one of them used a hammer or a stick or if one of'em didn't want to fight but from what I heard they were both willing .
