HUNTINGTON, W.Va. (WSAZ) -- A man charged with helping his son and his son's girlfriend cover up the murder of a female social worker was released late Monday afternoon from the Western Regional Jail, a jail official said.

Steven Foster Sr. is charged in connection with the killing of Brenda Yeager, whose body was found Aug. 1 near her burned-out car. Rosemary Forney, the girlfriend of Foster's son Steven Foster Jr., had her preliminary hearing earlier Monday in Cabell County Magistrate Court. Steven Foster Jr. and Forney, both of whom are charged with murder, remain in custody at the Western Regional Jail.

Steven Foster Sr. was released on a property bond, according to the jail official.

HUNTINGTON, W.Va. (WSAZ) -- Investigators revealed new information during a court hearing Monday about the events leading up to a social worker's murder.

Trooper James Kirk with the West Virginia State Police testified during Rosemary Forney's preliminary hearing that she confessed to killing Brenda Yeager along with Steven Foster Jr.

According to Kirk, Forney says Foster Jr. was hiding in a closet when Yeager came into their home in Cabell County--and Forney turned up the radio to hide any noise Foster Jr. would have made.

Kirk says Foster Jr. then hit Yeager in the head with a frying pan. Both Foster Jr. and Forney expected her to black out, according to Kirk, but when she didn't, they held her at knifepoint.

Kirk testified that Foster Jr. and Forney then tied Yeager to a mattress--and while Forney went outside to clean Yeager's car and hide it, Foster Jr. sexually assaulted Yeager.

Kirk says Forney told them that she and Foster Jr. then discussed the situation, choosing between letting her go so she can call the police or killing her to solve their problems. The two chose the latter, according to Kirk, and Foster Jr. told Forney to kill Yeager.

Forney proceeded to try to suffocate Yeager, but failed, according to Kirk. Foster Jr. then also tried to suffocate her, but also didn't succeed, says Kirk.

Kirk says both Foster Jr. and Forney then simultaneously tried to suffocate Yeager, killing her.

Forney's attorney argued that his client's confession was coerced, but the magistrate didn't agree. The murder case against Forney has been bound over to the grand jury.

Foster Jr. and Foster Sr. were expected to have their hearings after Forney's, but they are expected to waive their preliminary hearings.



ORIGINAL STORY
HUNTINGTON, W.Va. (WSAZ) -- A court hearing has started Monday morning for the three suspects police say were involved in the murder of a social worker from Lincoln County.

Steven Foster Jr. and his fiance, Rosemary Forney are charged with the murder of Brenda Yeager.

Court documents say Yeager went to the home of Steven Foster and Forney on July 30th. The papers say the three got into an argument over a baby and that led to a fight, which then led to Yeager's murder.

Foster's dad, Steven Foster Sr., has been charged with helping the two cover up the crime after Yeager's body was found burned near her car, which was also burned. Yeager was found on August 1st.

The preliminary hearing for the three is set for 10:30am in Cabell County Magistrate Court. We're getting word that it has just started.

Please WV, in the next election, make sure you put politicians in there that favor the death penalty. West Virginia needs to have the death penalty enacted. This murder being a prime example. No need to waste tax dollars for them to rot in jail, these 3 are of no use. Wish we could have hangings.

Decomposing in the earth? That shows how people really are and how they talk. Can we just not let this woman rest in peace. From what I have read Brenda had alot of friends and family that loved her dearly so let her family and friends grieve and leave all the negative comments to yourself.

To Stephanie I do think about what if it was my mother what if I didn't know one of the people that did this would I be saying the terriable things that everyone else on here is saying. Probably I would have. I now have been on the other side and I can say that for now on I would say that I would pray for both sides. It is terrible what happened to Mrs. Yeager but stop and think about it what if your child or someone you loved killed, raped or just hurt someone. Would you still love them? Would you still pray for them? Then think how you would feel if someone was saying the things about your child that people are saying on here. Would it outrage you? I can say that these people on here outrage me! It is terriable what they did but they will pay for it in this life and the next. I hope that they do ask for forgiveness from God but that just shows that I have learned something from all of this. You can't tell me that not one person on here has never done anything to hurt anyone

I just want to say that what these two people have done is so disturbing. I think they should be locked up, so they can never commit a crime so terrible as this again. I am also distrubed by some of the comments I see here. It sounds like some of you, making these comments, are as bad as the two in jail. Some of the things you are saying makes you as evil as them. Lock them up and throw away the key but I could never torture another human being as you are suggesting. I know you are going to say that they are not human, they are animals, but in God's eye's they are human.

I cannot believe that Steven Foster was released! I mean it said he HELPED them murder her. I don't think he should of been released, and I also think that if they were to put a bond on him, it should of been very un-affordable. Lets hope he doesnt leave the state. Cherie, i dont think criticizing the W.V. people by calling them imbreds was very nice. Some people are just inconsiderate and dont think if they were in other peoples shoes. Gerber:We need Social Workers to help keep our children safer. They shouldnt live with parents who are drug addicts, molesters, etc. If some people took raising their children seriously, and provided them with love and support like children need, social workers wouldnt have to be involved. Ok this person whom wrote this comment is not only uninformed, but severly mentally disabled it seems because of the fact that she doesn't have the authority to take a child on her own and secondly who cares even if she did have the authority why did she deserve to die for it. To Brenda's family, There are no words to make this situation better. As bad as it is, the new details only magnify an already tragic situation for you all. I am so sorry that you all have to deal with all of this "garbage" that people are posting, on top of the fact that your hearts are already torn apart. There are alot of people on here posting useless comments. What if this was your family member? How you would feel then? You wouldn't be on here posting these types of comments saying that Steven Sr is innocent, you wouldn't be posting comments on how Rosemary was scared of Steven, you would want JUSTICE to be done to ALL 3 of them, just like Brenda's family wants. People make me completely sick with the things they write on here. So what if she was there to take a child (WHICH SHE WAS NOT) apparently the child did need to be away from the parents because look at them look at what they did. Brenda was a loving woman who was helping them with there infant child, and lost her life in the line of her work, due to stupid ignorant people. I didn't realize there were many many sick individuals out there like you people that get on here and post things. All I have to say is THINK ABOUT IT, WHAT WOULD YOU BE SAYING IF IT WAS YOUR MOTHER? is really saddens me to think that people do not value a life anymore. what kind of society do we live in? my heart and prayers go out the the family of Brenda Yeager. the community lost a wonderful, caring, special person. i think the laws and/or policies need to change. i am put in the same sort of situation with my job every day and its sad that you really dont know just how safe you are dealing with the public in such a manner. "Brenda's Law" sounds like a good idea. there are ways to lobby the legislature to get something in place. maybe thats something that needs to be looked into.

It is policy and law that Child Protective Service Workers keep families intact if at all possible. They have a rare job, they must substantiate abuse and/or neglect and then work with the family to keep them together. They must have a four year degree to perform this job. They never know if they are going out to a meth lab/drug deal/or domestic altercation. Their pay is extremely low, yet they still perform this job daily knowing the risks they face. Our Legislature and the Govenor could have passed laws to protect State Employees and make threats and those who have hit clients face a felony but they only face a misdemeanor now. However, our State choses to allow CPS/APS/WORKS workers to work in dangerous situtions. I know I am speaking for all Social Workers in this State when I say OUR STATE TRULY LOST A GREAT WORKER WHEN WE LOST BRENDA YEAGER. Just please don't allow her death to be for nothing. E-mail the Govenor and your Legislature for better pay and safer condition.

My sympathies go out to the Yeager family. I'm so sorry for your loss. The animals who killed your loved one will have to explain to God on the judgment day why they chose to commit a heinous murder before they are given directions to H-E -double hockey sticks. I hope they get the fullest punishment allowed by law. Now this To take a child at 839 it sounds like you are an evil, drug addicted piece of uncaring scum! I'm glad you had your child taken away. That person maybe had their facts wrong but the comment is still terrible just the same. And even if the facts are wrong about why she was there, she was there to help them. Let's keep this simple and deal with facts. A woman came out with supplies for this "family". One of the receipients hid in a closet and whalloped her over the head with a frying pan. She was then tied to a mattress, sexually assulted and repeatedly suffocated by two individuals until she finally passed away. That makes this a murder and sexual abuse case. Do you think people guilty of this type of behavior are capable of being good, loving parents that set a good example for a child? Are they capable of controlling themselves under stressful situations? That clears things up a bit, doesn't it.

To take a child....I feel very sorry for you....you are a scary type, evidently much like those that killed my former co-worker and friend Brenda Yeager. I hope beyond hope that if you ever in your life need help of any kind that those that are around you support and HELP you rather than take your life. Social workers are not the enenmies here...we do not randomly decide to come into a person's home and take their children. It is usually under advisement from the court systems, and is usually for a reason, and the children are in need of HELP because their parents cannot provide the support and HELP they need. So ya know what?! God help you...he's the only one who evidently can, when such views are placed on a place where Brenda's family and friends can see this....SHAME ON YOU. I am appalled. When a Coal Miner is killed, our Govenor is the first at the scene. He advocates for safety and promises to bring change for the families of the deceased. When a State Trooper is killed, he again is first to lower our State Flags to half mass. Now that a social worker is killed, where is he? Now is the time, that he can step up the podium and make change. West Virginia State Social Worker put their lives on the line daily, however, unlike State Troopers they do so without a bullet proof vestwand without the gun. I do not believe CPS workers or WORKS workers should be given a gun, but there are improvements Our Govenor could initiate if he so chose. State Workers should remember this in November.

Let's set one part of the record straight. Brenda DID NOT work for CPS. She worked for an agency to provide the Right From The Start Program. RFTS is a program for high risk mother's and their infants. It is a VOLUNTARY program. In other words, Rosemary Forney agreed and signed up for this service, knew that home visits would be done and agreed to them. RFTS is a wonderful program and the workers HELP the families they see; they are in NO WAY CPS workers who remove infants from homes. May God Bless Brenda and bring peace to her family now.

STEVEN FOSTER SENIOR IS THE ONE WHO TURNED HIS SON IN WHEN HE WAS TOLD ABOUT IT. IS HE GUILTTY OF DRIVING HIM TO THE GAS STATION..YES! I totally agree with Rosemary's cousin's comment. This is not the Rosemary that her family and friends know. To the ones that say those of us who are sticking up for them should be ashamed of ourselves. I am only sticking up for Rose. I have known her family all my life and have known Rose ever since she became part of that family. This is not her. Something else had to have happened. There is something that is not being told. I believe that she was afraid of Steven.

Okay. i must say it is remarking how screwed up the information surrounding this is. in the beginning of all this the POLICE believed she worked for CPS, but she DOES NOT work for CPS. She works for an agency that comes into the homes of pregnant woman and helps them with their pregnancy and their babies for the first year of the babies life. HELPER! NOT TAKER! IF rosemary was afraid of him why wouldn't she have helped brenda knock him over the head or take brendas car and go to the police to arrest him and protect her. NO they made the brightest decision they could muster into their pee-sized brains. killing her will solve all our problems. Nuff said. And to Take a child all i can say is CPS must have taken your child(ren) for you to be so bitter regarding the work they do. just because you can have children---doesn't mean you should. i just pray her family doesn't see the words you typed that are as sick as the crimes they commited on brenda. I havne't seen this woman show one ounce of remorse or sympathy for what she has done. She seems a little as-a-matter-of-fact about the whole thing. I somehow doubt that she was afraid of Jr. I do not believe her adopted parents are to blame for her behavior, I blame her. She stated that she and Jr discussed letting Brenda go or to kill her. She was involved in the torture, and in the killing. She never said he made me do it. She said we discussed it. Death is a punishment to good for either of them. They need to suffer, for they made Brenda suffer. And in the end, it will be up to God to judge those two. And I am sure Brenda will be with God to see justice through.

Truthfully it would be a relief if someone with your intelligence or lack thereof were unable to have children. The fact that you think what these three animals did was justified is frieghtening.I would be willing to bet that you didn't finish high school and that everything that is wrong in your life is someone elses fault. Now if that wonderful woman was there to remove a child from a bad environment, she still accomplished her mission because those idiots will never get to experience the joy a nurtering one of God's greatsest gifts.Please, if you are able to have children get on birth control,I'll help you pay for it, oops, I forgot we probably already pay for it. I brings me to tears to think what this woman went through. Where does this evilness come from? Young people who should be going about their lives, working, buying a home, raising a family, instead obviously planning and executing a plan for what end? So many people are continually fighting Bible teaching and Bible principles. When I went to school, there was a banner in the hall that said, "Do under others what you would have them do under you." I didn't know this was from the Bible but I got the message. The story of the Good Samartin is about taking care of someone in need other than just "your four and no more." It is time that we woke up and realized that our young people need moral directions. We are are free country soon to be enslaved by the allowing a few to tell us how to live and raise our children.

Regardless of what u or anyone else says they are very wonderful people and i think its sad that you would "assume" that they arebad parents. Ive said this before and i will say it again. They are the best parents anyone could ever ask for. It was because of them that rosemary was takin out of the enviorment that she was in. It breaks my heart to hear that they are such bad parents WHICH IS NOT TRUE!!!!! Its not there fault that she commited this crime. People make there own decisions. I understand she has done wrong. But it is not my aunt or uncles fault. Maybe its caused from her childhood and how her real parents treated her. I dont know. You all dont know her past, not saying its an excuse for this womans murder. Buy u cant blame her parents.

Just wanted to add that last night WSAZ reported Rosemary had given birth to twins but one had died. that could have made her even MORE susceptible to his control to the extreme extent of doing what he told her without question? even to the point of committing murder? If you haven't been controlled, manipulated, abused & brainwashed (and yes folks, they can DO it to you) by an abuser, you don't KNOW what power & control they exert over you. As I said, I would never have gotten to that point despite all my abuse, control & brainwashing I don't THINK. Thank God I never did. BUT different people have different breaking points & amt of strength. Thank God that He gave me strength enough to survive mine & come out of it still a decent, loving, compassionate person. This girl just looks dead inside. Her eyes look dead & so sad for one so young. Yes she apparently participated & YES she should pay BUT I think she was terrified of him & truly under his control

remember the defense atty name...if there is ever the chance they want to run for office.....as a social worker I am very greatful I work for an organization who prvides me with more safety precautions than most organizations...thanks...you know who you are...Also...I keep saying this...Please remember....not all social workers work for the state...we ALL need protection....so there should be laws passed that work across the board...even if it means providing two way radios to any social worker who works in the field...and self defense classes...and yest sending us two by two at the times when we feel not so comfortble about being alone...another thing...more often than not we are women...like teachers we are under paid...and under apreciated....things really need to change

Im in NO way trying to condone this girls part in this horrific crime, BUT what IF she too was terrified of this kid. She was living with him & his Dad. I dont know if she had family of her own who didnt want her anymore or what. Maybe if so, she had no one else & she was afraid of what he would do to her and/or her baby. If you've never been in an abusive situation like that like many women who arent strong to begin with, the abusers can twist your mind & brainwash you. THAT is TRUE. My own parents & an ex did that to me. NO - not to the point I'd participate in killing anyone or anything. I would have taken my chances on dying myself at their hands first rather than hurt anyone else, BUT I didnt have a baby at risk either. She did. I'm just trying to look @ possibility he had her brainwashed & terrified for her & her baby. THAT doesnt lessen what she did by any means. What they did was beyond horrible. God knows what she too went thru with him thats all

Putting theses people to death would only be a favor to them. Let them suffer & think about what they did for a bit! Someone innocent died here. She was just doing her job & trying to help the community. I did not know Brenda Yeager, but I feel for her family. They will think about this everyday for the rest of their lives because someone made a stupid mistake.Now there are children with no mother [ I assume] Mothers without a daughter, sisters without a sister.. Everyone in her family lost something dear to them. Let these people pay for what they have done!

Again,this tragedy needs to wake up not only this state, but our country to the risks being taken every day. While I understand the calls for background checks on these clients it is also a flawed idea. The only background check that would be performed would be on the client and in this program that is either the mother or the baby. The boyfriend/father is not the client, therefore I don't believe they would be allowed to provide that information unless they make the entire "family" the clients. This country is so afraid of stepping on anyones rights or toes that they allow innocent people to die before they realize that SHE also has the right to do her job and not have to be in fear for her life. Giving them guns is not the answer because they can be used against them if taken. Funding for paired visitation maybe. I don't know what the answer is, but I know whatever the answer is involves money and this state better be prepared to put their money where their mouth is. God Bless Brenda

as a home health nurse, this really terrifies me. i have been in so many homes and it just makes me cringe. i know with our agency they always told us that if we felt uncomfortable at all to leave and make other arrangements such as go in two's. she probably never even felt uncomfortable about going and doing her job at the time. i know from now on i will be watching over my shoulder and will never feel safe in peoples homes again.

They are a very caring family and have always been, the have other wonderful children and actually this is not the same Rose that lived with them. She changed when she started hanging around Steven and has never been the same since. To blame the parents of either party is ridiculous though. I am sure you have done things in your life that you shouldn't have and not that the would compare with what they have done but it wasn't your parents fault either, you made the decision to do what you did, you and you alone.

Being ignorant, uneducated, poor, and/or otherwise disadvantaged is no excuse for lack of morals, lack of sympathy and lack of remorse for their actions. Brenda Yeager was a good person with a kind and caring heart. Brenda's death is such a tragic loss for everyone. I know her family's hearts are just broken. I pray that some how in the future Brenda's family will find some sort of peace and healing. I believe God gives special people gifts and Brenda's gift was helping others. I feel even in death Brenda helped save a life of a child from pain and suffering. One can only imagine what the child would have suffered if left in the hands of such cruel and heartless parents.

To Sandra: A lawyers job is to defend someone that needs an attorney. If a lawyer was to pick through a pile of papers of people they thought was innoncent they wouldnt be able to feed their families. Read the percentage rate of people that are truly innoncent when tried for a crime: slim to none. People need lawyers and lawyers are taught in school: innoncent until proven guilty. It would be a violation of their rights if they wouldnt receive propers legal advice. Its up to the judge what their future holds.

Now, let the trial begin - let's "round-up" a jury of their peers. To plan and commit a crime such as this, I'm sure they have wronged others who would love to serve as a juror and recommend the "appropriate punishment". It's to late fot this poor lady but i think a police officer should accompany social workers to homes. She was innocent doing her job and I'm sure has no idea or never even though about what could happen to her. If a social worker is called out to do a home visit there is usually a problem to begin with. Give them a gun or have an officer go with them. God bless Ms. Yeagers family.

This lady was trying to help these two people and lost her life...and they are going to try being the victims because they are poor. You know they will have to have psychiatric evaluations and Foster Jr. is probably BiPolar and Forney was scared of him so she went along with whatever he said to do. Of course I'm making a guess that this all happened while their baby was right there with them. With the Judicial system in WV they will be out to do it again in maybe 5 yrs..and those 5 yrs will probably be spent in a nice psychiatric facility so no one will have the chance to harm them and hinder their mental state further.

Really people....what has to be done before Social Workers get protected..Social Workers deal with the same people the police deal with...However Social Workers dont have guns, vests, batons, etc..I dont thinks Social Workers are even allowed to carry pepper spray...Social Workers cant be in someone's home every minute of everday to see that children are protected however they are expected to..Dont think for one minute of something happens to a child and Social Services are involved that the Social Worker will get the blame for it...What more needs to happen...Do Social Workers not matter...is there not a need for them...You would think they would be protected a little more...if nothing ever changes they will just be killed off one by one...Maybe it takes a Social Worker who's father is the Governor or in something other political affiliation for something to get done...

The agency she worked for, was it strictly volunteer just to help those in need? Not clear on that. Sounds like thats all they do is HELP people who need it. SO, if that's true, why did they seek help from her agency in the 1st place if they feared losing their baby? Did they let the agency just volunteer to help them? How does that work? Guess I'm trying to get at, is that they didn't HAVE to have the lady in their home IF her agency is strictly volunteer help so why didn't they simply tell them they no longer needed them? Rather than let Brenda or anyone else come there, see how they were living/taking care of their baby and then torturing and killing her for heavens sake. Hope this makes sense & would like to know if her agency really was simply volunteer to HELP these idiots. If so, all they had to do was terminate their request for help then isn't it? No, they have to take this lady's life! This was premeditated so why not just cancel the visit?

What was the dispute over the baby about? Was the baby in the home at the time? It doesn't sound to me like there was much of a dispute if he just hid in the closet when she came. What a bunch of sick individuals. I can not believe that people would do this! I just don't understand. It must be horrible for the family to hear the way they treated Ms. Yeager. I hope they give them the maximum punishment allowed. They deserve worse.

It is a sick thought that people like this actually exist and live among us. Heaven forbid she didn't die when THEY wanted her to so they both had to do it! And the sad part is...at the very least, we can lock them up and feed them and give them clothing and somewhere to sleep. And if they have any family that may want to see them then they are allowed to have an occasional visit or letter. Where as this poor woman who struggled for her life will no longer see her family and no one can send her a letter or see her. I can't believe that a person who goes out and tries to help others gets this and the ones who does it just sits back. I know that there may be some social workers out there that may have a vengence but the other 95% are truly good people trying to help people. I don't even know what the punishment should be but it should painful and take awhile. God bless this lady's family and all of the other people out there that put their lives at risk every day.
