CHARLESTON, W.Va. (WSAZ) -- Former West Virginia Supreme Court Justice Thomas McHugh is back on the bench. He'll fill in this term for Justice Joe Albright, who stepped down temporarily for health reasons.

Justice Albright has been recovering from an esophagectomy that took place in a Pittsburgh hospital in July. He has been advised by doctors to rest until the new year.

Justice McHugh retired from the court midway through his second 12 year term on the court in 1997. He is an active private lawyer in the Charleston community. He starts work on the bench Friday.
