CHARLESTON, W.Va. (WSAZ) -- The man convicted of stockpiling more than a thousand tires in a Nitro warehouse without a permit plans to appeal his case to the Supreme Court.

Ricky Handley's attorneys filed a notice Wednesday that they plan to appeal with the State Supreme Court.

His attorneys also asked a Kanawha County judge to set bond for Handley until the appeal process is over, but the request was denied.

Handley is currently serving a prison sentence of up to five years.

DEP inspectors say Handley kept the tires at a warehouse that caught fire two years ago. The fire burned for almost a day and it took more than a million gallons of water to put out.

Handley's attorney, Mike Clifford, says he can't believe investigators went after Handley and not the people who owned the actual warehouse.

WHO DID MR. HANDLEY CONSPIRE WITH? I DON'T THINK YOU CAN COMMIT A CONSPIRACY ALONE.YOU WOULD THINK THE OWNERS WOULD ALSO BE HELD ACCOUNTABLE.MAYBE THE JUDGE AND THE OWNERS AND MR. PEYTON CONSPIRED ALONG WITH MR. HANDLEY'S FIRST LAWYER TO HAVE HIM THE ONLY ONE TO BE CHARGED. I THINK SOMEONE SHOULD BE INVESTIGATING ALL OF THIS.THERE IS SOMETHING WRONG WITH THIS WHOLE THING.I READ WHERE THE JUDGE IS UP FOR RE-ELECTION. MAYBE ITS TIME TO REPLACE HIM. I BET HE IS A DEMOCRAT.I PRAY THAT SOMEONE IN WV WILL LOOK ONTO ALL OF THIS MORE BECAUSE THERE IS DEFINITELY SOMETHING ROTTEN IN WV.

THE FIRE HAPPENED IN MAY 2006. HANDLEY LEFT HIS JOB AS MANAGER NOT OWNER IN MARCH.

This comment is for Pablo: Ok, I think you need to read things a litte closer, because if you would have you would see that this man was not the owner of the business. So with that being said it would be the business owners responsibility to make sure that they had all the permits that they needed to run their business. I'am a business owner myself and I know all my responsibilities as that role. So therefore none of my employees would ever be at fault for something I did not do! So there have it Pablo! Learn to READ!!!!!! And why would you say rot in prison? You need to learn some class my friend! He did not do anything wrong!!!!!

PABLO YOU NEED TO GO BACK TO MEXICO. HANDLEY DID NOT PROFIT FROM ANYTHING. HE WASN;T EVEN WORKING FOR THE OWNERS WHEN THE FIRE HAPPENED.

He needs to be let go. Get the building owners. I think that they needed it and wanted to collect the insurance.

He should be given more than 5 years. He knew he was breaking the law. Storing tires like this is not much different than storing gasoline. He put not only neighbors close to the warehouse in danger, but the firefighters who had to extinguish his mess. He purposely broke the law and now he wants out of prison. And if that isn't bad enough, some of you posting in here want him out. Would you want to live next to a warehouse that had that many tires stored? We have regulations such as this to make it as safe as possible in our country. Regulations are important to a civilized society. If you don't believe me, just look at the economic mess we are in. Bush/Cheney and the republican congress they had for 6 years deregulated many of the controls that keep the lending and morgage companies in line. Now we are all paying the price for thier deeds. These tires were stored improperly. Mr. Handley knew it. He didnt'care about anyone's safety, just profit for the company. Rot in prison, sir.

Ricky Handley must have thought he could make some money with the tires , people will pursue a profit even when its a bad idea . He is the victim of West Virginia's zealous pursuit to regulate everthing under the sun . I see the DOT on the highway hounding and harrassing truckers , the DEP with all the crazy regulations they impose on us , the Fire Marshall running around the state with blacked out windows justifying their existance by showing up when someone burns some garbage , the dept of labor forcing people to get a license to build a dog house .where does all this regulation get us ? It gets business people to leave this state and others to not consider West Virgina when looking for a place to open shop !It gets us more state employees to pay and provide benifits for , as taxpayers we should be able to mandate a cap on state employment , but instead most will tolerate all the assinine petty state officals who have nothing to do with our productivity or standard of life in WV.

I can not believe this Judge denied his request for a bond! He wasn't even the owner of business< he was a manger. Its nice to know how our court system works! (idiots)

Isn't it ashame that Kaufman's justice is different at election time. Even though no one is running against him. This will be overturned by the supreme court. Rapist go free and this business man get 1 to 5 the streets are safer Judge.
