CHARLESTON, W. Va. (WSAZ) -- A handful of Republican delegates in West Virginia want a ban on same sex marriage placed on a ballot.
The Republicans called for Governor Joe Manchin to place this issue on the call of any special session this year, so legislators can start the process of making this a constitutional amendment.
Delegate John Overington (R-Berkley) said the "defense of marriage act" can be overturned by the courts. That recently happened in California. He said West Virginia must act now.
Eight years ago, lawmakers approved the Defense of Marriage act which made traditional marriage of a man and woman the legal standard in the state.
42 states in the country have laws defining traditional marriage and 27 of those also have constitutional amendments banning gay marriage.
