CHARLESTON, W.Va. (WSAZ) -- For a second time, a West Virginia gubernatorial candidate has been denied the right to appear at a debate in Charleston.

Mountain Party candidate Jesse Johnson filed an injunction last week against the West Virginia Broadcasters Association and the Clay Center.

Johnson wanted them to include him in the October 13th debate, but a judge denied his injunction on Thursday. Kanawha County Circuit Court Judge Jennifer Bailey Walker told Johnson the FCC should have considered the case, not a judge.

A spokesperson with the West Virginia Broadcasters Association says the group's policy is to invite only the two major-party candidates for the debate.

Back in 2004, Johnson filed a last minute injunction to be part of another gubernatorial debate, but it was denied.

I'm voting for Mr. Johnson because our current governor is a joke. Apparently he has so many people fooled, but he is seriously hurting our state.

This is SUPPOSED to be a democratic society BUT as we all know especially with recent events, it's far FROM being a democracy! IF you dare dissent from the two "parties" of power (I dare say probably 98% of us NOW do - we're fed up with BOTH), then you are NOT allowed a voice! NONE of us but the mega-rich & powerful/greedy are allowed to have a voice period! I don't like Ralph Nader BUT he has a right to be heard in debates, have his ads run on tv etc as the 2 "main" parties but they sure shut him out & joke about him. Same with any other normal person who wishes to TRULY make a difference in this country's so-called democracy! How democratic ARE we when we won't even allow anyone other than those two main parties to even be in debates, have ads shown or run, or be on a ballot? Not very. We NEED a viable 3rd party to take over & lead this country b/c the other two sure arent getting it done What are they afraid of? Ha! Easy answer there. as for this guy let him in!

They don't want anyone in office that would do the right thing. U.S.S.R. United States Socialist Republic!! Think I'm out of my mind? Take a look around and the events of the last few months!! I don't know if this man would be the right man for the job, but that's not point. He has the right to be heard, and the people have the right to hear him!! So now a Judge wont hear his case and the WV Broadcasters Association say to bad so sad!!! This is how a socialist republic operates. If the people don't stand up and stop this; who knows what will happen next! I'm voting for this man just because of this!! He can't screw anything up that our Gov. hasn't already.

Karen that's crap and you know it.....was Reagan not an actor? Schwarzanegger? Geez, Bush has been acting for 8 years now. I think Jesse Johnson deserves to be there just as much as Joe and the other guy. I for one will be voting for Mr. Johnson on the premise that I will not vote for anyone who is already inn office.

I don't think he should be included in the debate. Read his website. He's an actor who just wants to get his face on TV.

People wake up! They DO NOT want you to have a choice. There is but ONE party with Sub Party A and Sub Party B. They are doing the same thing to Ralph Nader. Exclusion. They do not want people bringing up real issues like health insurance and the economy, helping the working poor, etc... they want to keep you baffled with flag burning or gay marriage. Stop the madness. Americans can have anything they want, they just don't appear to want very much. Exclude THEM this election and vote for real change.

All candidates should be allowed to participate. Third party candidates will never be elected if we are not allowed to hear their views.
