UPDATE | Charges unlikely after 3-year-old boy dies in Nitro accidental shooting

Charges are unlikely to be filed against the father who left a loaded gun out within the reach of his 3-year-old son, Nitro Police Chief Bobby Eggleton said.

A 3-year-old boy died Wednesday night after accidentally shooting himself in the head inside a Nitro home.

The shooting, which claimed the toddler's life Wednesday night, was an accident, Eggleton said. The final decision on possible charges will be made next week by the Kanawha County Attorney's Office, Eggleton said.

"I just have to say that people have to be more careful," Eggleton said. "You know, it is very difficult. As a father myself of much older children, you have to just be very careful with this stuff."

Monica Scott, a gun safety instructor, said this accident is devastating but could have been prevented by following weapons training.

"The guns need to be unloaded," Scott said. "It's fine to have the magazine nearby, but it does not have to be loaded with children in the house."

Scott has a 4-year-old and 10-year-old daughter who have been trained since birth that guns are not toys. Teaching children at an early age to not touch a gun will keep them away from guns until they learn proper handling, Scott said.

"Guns can protect you, but if you don't use them properly, they are a weapon," Scott said. "They by themselves can't hurt you, but if you are ignorant, then you need to be taught proper rules."

A 3-year-old boy who accidentally shot himself in the head Wednesday evening has died, Nitro Police Chief Bobby Eggleton said.

The accident happened around 6:30 p.m. inside a home in the 1300 block of Main Avenue.

Investigators say the boy's father was home at the time and had left the firearm out because he was getting ready to take it with him somewhere.

The toddler's name has not been released yet.

A 3-year-old boy accidentally shot himself in the head Wednesday evening in Nitro, city Police Chief Bobby Eggleton said.

The boy is critically wounded and was taken to the hospital, police say. The accident happened around 6:30 p.m. inside a home in the 1300 block of Main Avenue.
