KANAWHA COUNTY, W.Va. (WSAZ) -- A case against a man charged with DUI causing death is headed to a grand jury.
Kevin Statts was in court Friday for his preliminary hearing.
In March, Statts was involved in a crash that resulted in the death of James Kidd. It happened on Frame Road in Elkview.
According to police, Statts crossed the center line and hit Kidd's car head-on.
Police say Statts was too impaired to operate the vehicle safely and there was no indication that he tried to stop before the impact.
A grand jury is expected to consider the case sometime this fall.
KANAWHA COUNTY, W.Va. (WSAZ) -- The wife of a Kanawha County man who was killed by a suspected drunk driver is speaking out in hopes to prevent another tragic accident from happening.
Early Monday morning, on March 13, 2017, Amy Kidd received a phone call from deputies saying her husband, James Kidd, was killed in a head-on car crash. Amy says James, her husband of 14 years, was on his way home from a friend's Sunday evening.
"He just never came home. I called his cell phone multiple times. No one answered. I called his buddy. He said he should have been home a long time ago," Amy said.
Kevin Statts faces charges of DUI causing death. The criminal complaint says Statts was driving along Frame Road when his car crossed the double yellow line, hitting and killing James.
The complaint states that "Statts was too impaired to operate a motor vehicle safely" and had a blood alcohol content of .08 when the crash occurred.
Amy says James was a father of three. "He had so many questions: who's going to take me to baseball? Who's going to teach me to drive? Who's going to teach me to change the oil? Little stuff I would have never thought of," Amy said, talking about their youngest son.
Kanawha County Sheriff's deputies say it's important for drivers to always be vigilant when behind the wheel. If you see someone you suspect is drinking and driving, call law enforcement.
"No matter what time of day it is, no matter what location -- if it's a holiday or a weekend, we're saying the same consistent numbers throughout the week on the weekends. That's with alcohol and drugs," Lt. J. H. Thaxton said.
In the midst of her family's pain, Amy has a message for drivers to think about before driving while intoxicated: "You hit someone and you killed them. You have to be responsible for the rest of your life with what you've done. It's not worth it."
Statts was taken to jail on a $100,000 bond. His preliminary hearing is scheduled for Wednesday June 7.
