UPDATE: Huntington man charged with murder back in court

A man from Huntington charged in another man's murder was back in court Monday, and a judge denied a motion to dismiss the case.

Ronald Witherel is accused of stabbing David Ralph to death in July 2017. It happened in the 800 block of Virginia Avenue in Huntington.

A grand jury indicted Witherel on a murder charge, as well as first-degree robbery.

Earlier this month, the defense presented a motion to dismiss the case based on grand jury instructions. They said instructions were given in February, and the case was presented last December.

On Monday, Cabell County Circuit Judge Gregory Howard denied the motion to dismiss.

Earlier this month, the defense also presented a motion to severe, saying the issue is whether the robbery and murder charges should be tried together or separately. Judge Howard said he would take the motion to severe under advisement.

Although no trial date has been set yet, a status hearing is scheduled for 9 a.m. Nov. 27.

A grand jury has indicted a man for murder.

Ronald Witherel, of Huntington, was indicted Friday on charges of murder and first-degree robbery.

According to the criminal complaint, Witherel stabbed David Ralph to death on July 19 in the 800 block of Virginia Avenue in Huntington.

Court documents also show Witherel also robbed a man of a gold chain on July 10 from a bar in the 1500 block of 3rd Avenue.

The chain was found at a pawn shop in Ashland, Kentucky.

HUNTINGTON, W.Va. (WSAZ) -- A case involving a man charged with murder is now headed to the Grand Jury after a preliminary hearing Friday.

Ronald Witherel, 40, of Huntington, is charged with murder and second-degree robbery.

According to the criminal complaint, Witherel stabbed David Ralph to death on July 19 in the 800 block of Virginia Avenue.

Witherel was arrested in July in Lawrence County, Ohio.

Court documents show Witherel also robbed a man of a gold chain on July 10 from a bar in the 1500 block of 3rd Avenue.

Witherel then ran to a vehicle that had been waiting and took off from the scene.

The chain was found at a pawn shop in Ashland, Kentucky.

Witherel was wanted for the murder of David Ralph.

Witherel was sent to jail and without bond.

HUNTINGTON, W.Va. (WSAZ) -- A man charged with murder has been extradited back to West Virginia.

Ronald Witherel, 40, of Huntington, is charged with murder and second-degree robbery.

According to the criminal complaint, Witherel stabbed David Ralph to death on July 19 in the 800 block of Virginia Avenue.

In July, Witherel was arrested in Lawrence County, Ohio.

Court documents show Witherel also robbed a man of a gold chain on July 10 from a bar in the 1500 block of 3rd Avenue.

Witherel then ran to a vehicle that had been waiting and took off from the scene.

The chain was found at a pawn shop in Ashland, Kentucky.

Witherel was wanted for the murder of David Ralph. A retired Huntington Police officer who knew Ralph said his friend had a great heart for helping people, and he fears that could have led to Ralph losing his life.

Witherel was sent to jail and without bond.



UPDATE 7/21/17 @ 3:35 p.m.
HUNTINGTON, W.Va. (WSAZ) -- Huntington Police say a dispute led to the death of a man on Huntington's west end.

Ronald Witherel, 40, was arrested Thursday afternoon in Lawrence County, Ohio, on a murder charge.

Police say David Ralph suffered cutting injuries that resulted in his death at his home in the 800 block of Virginia Avenue.

HPD say Witherel was also wanted out of the state of Washington for robbery, and he was also involved in a robbery in Huntington a week before the murder.

Police say they haven't ruled out "substances" as a factor in this case.

HUNTINGTON, W.Va. (WSAZ) -- Huntington Police have released the names of a suspect and victim in a murder investigation.

Officers say Ronald Witherel, 40, is wanted for the murder of David Ralph.

Police say the incident happened Wednesday in the 800 block of Virginia Avenue on the city's west end.

HPD tell WSAZ Witherel is also wanted for robbery and grand larceny from an incident earlier in the week.

Police say Witherel has a lengthy criminal history and should not be approached.

If the public has any information on where Witherel may be, call 911.

UPDATE 7/19/17 @ 8:30 p.m.
HUNTINGTON, W.Va. (WSAZ) -- A woman says she may have seen the killer right before and after a homicide in Huntington Wednesday morning.

"I was in shock," Angel Brumfield said. "I was nervous and scared."

Brumfield works at an assisted living home across from the house in the 800 block of Virginia Avenue where police say a man was killed.

She was standing on the back deck taking a break a little before 5 a.m. when she says she saw someone acting suspiciously.

"I saw the guy take off from around the dumpster area to the guy's ladders," she said. "He stood there for a second and got down on his hands and knees and went to go around the garage."

She says she suspected the man was up to no good.

"I thought maybe he was going to try to steal some of his work equipment," she said.

Brumfield says she yelled at the man.

"He turned around, but he couldn't see me," she said, "so he turns around, and I holler again. I say 'I will call the police if you don't leave there.'"

She says she had zero suspicion someone was about to be killed.

"It never crossed my mind one bit," she said. "When I hollered, I thought he was going to come back out on the other side of the garage. I thought it scared him, and he was wanting to get away in the dark."

She says the man crawled out of sight, and about a minute later, she heard a gunshot.

"After I heard a gunshot, I heard screaming and hollering, dogs barking, and then the guy comes running out and (runs) up the alley," she said.

The victim's body was found inside the house. Police had the area taped off all day.

"It's just really scary to know someone was killed right across the street from us," neighbor Pam McCoy said.

Brumfield says the man who was killed was well liked and volunteered at the church next door to his house.

"If anybody needed anything done at the church, he would go over and help them out, fix things for them," she said. "He even installed our windows here, and he was wanting to build a gazebo for the residents. He was just a nice guy, and he didn't deserve what happened."

Brumfield says she was not able to get a good look at the face of the man she saw running from the crime scene.

The victim's name has not been released yet.

Police say they do have a person of interest in the case.

HUNTINGTON, W.Va. (WSAZ) -- Huntington Police confirm to WSAZ they are investigating a man found dead as a homicide.

Officers responded to the 800 block of Virginia Avenue on the city's west end early Wednesday morning.

Police say they have a person of interest in the case.

The man was found inside the home.

Police say another person in the home called 911.

HUNTINGTON, W.Va. (WSAZ) -- Huntington Police Chief Joe Ciccarelli tells WSAZ the department is investigating a possible homicide.

Chief Ciccarelli says they received a call about a man found dead around 5 o'clock Wednesday morning.

Police are on the scene investigating a home in the 800 block of Virginia Avenue on the city's west side.

Huntington Police forensics and detectives are investigating the case and the investigation is ongoing at this time.
