UPDATE: Martin County man faces upgraded manslaughter charge, arraignment delayed
Thursday a judge delayed the arraignment for Elwood Six.
Last month, a grand jury in Martin County upgraded charges against him.
He now faces a first-degree manslaughter charge. His new arraignment date is set for March 15.
A Martin County man faces upgraded charges.
A grand jury indicted Elwood Six last week on a first-degree manslaughter charge.
He initially was indicted for second-degree manslaughter. Police said Six shot and killed Rodney Stepp in December 2017.
We do not know the reason for the enhanced charge. Six's trial is set for June 17.
A man is in jail and a sheriff is recovering after an incident early Wednesday morning in Martin County.
Elwood Six, 66, of Inez, is charged with five counts on wanton endangerment on a police officer along with one count each of resisting arrest, menacing and disorderly conduct.
Deputies say they received a call to respond to the 100 block of Davella Road in Debord for a man who had been shot.
When deputies arrived on scene, they found Six standing beside what appeared to be a man with blood on the ground.
Deputies say Six ignored commands by police to show his hands. They had earlier been told by dispatch that Six was armed.
According to the criminal complaint, Six told deputies to "shoot me."
Martin County Sheriff John Kirk went to try and take Six down when he reached into his pants pocket.
According to the criminal complaint, Six was taken to the ground by multiple deputies and kept trying to reach for his pockets.
A handgun was removed from his right pants pocket.
Six's hands had to be forced behind his back and he continued not to listen to verbal commands.
Sheriff Kirk had to be taken to the ER as a result of the arrest.
He tells WSAZ he's a little sore, but is going to be alright.
The incident is in relation to the shooting death of Rodney Stepp, 46, of Debord.
Kentucky State Police say the case will be presented to the grand jury for any charges pertaining to the shooting.
