FedEx Driver Arrested on DUI with Injury Charge after Crash in Milton

MILTON, W.Va. (WSAZ) -- An on-duty FedEx driver was arrested Wednesday on DUI charges after a crash in Milton that sent another driver to the hospital, according to information from Cabell County Magistrate Court.

Timothy Scott Smith II, 26, of Clendenin, West Virginia, is charged with DUI with injury, criminal complaints show.

The accident was reported just after 4 p.m. Wednesday in the 200 block of East Main Street.

Smith was driving a white FedEx cargo van at the time. Milton Police say he smelled of alcohol, and officers found a nearly empty bottle of vodka near the van.

Police say Smith admitted the vodka was his, and he was then requested to take three field sobriety tests. He failed two of them and was taken to the Milton Police Department for a breathalyzer test. That test showed Smith's blood alcohol content was .164, which is beyond the legal limit.

FedEx released the following statement Wednesday evening regarding the arrest:

"The behaviors of the driver involved in today’s accident in Milton are not consistent with FedEx Ground’s high standards and he is no longer providing service for the company pending completion of this investigation. We are cooperating fully with the authorities."

The other driver, who suffered non-life-threatening injuries, was taken to St. Mary's Medical Center by a Cabell County EMS crew.
